Standard Terms and Conditions:

1. This competition is only open to UK residents, excluding employees of Picturehouse Cinemas Limited or any of its subsidiary companies, their families, agents or anyone else connected with this promotion. No third party entries, bulk entries or entries submitted by agents will be accepted. Picturehouse Cinemas Limited reserves the right to verify the eligibility of entrants. Picturehouse Cinemas may require such information as it considers reasonably necessary for the purpose of verifying the eligibility of an entry and the prize may be withheld until and unless Picturehouse Cinemas is satisfied with the verification.


2. Entrants must be over 18 and warrant such by entering this competition/prize draw.


3. Entries not complying with these terms and conditions will be invalid.


4. Entries received after the expiry date are invalid.


5. The instructions provided at the point of entry form part of the terms and conditions of this competition/prize draw, and in the event of a conflict, these terms and conditions take precedence.


6. Winner(s) will be notified of the expiry date specific to the competition/prize draw via email or through the Picturehouse Facebook page (in the case of the latter the winner(s) is/are responsible for seeking out the notification themselves), dependent upon the manner in which the competition/prize draw was entered. The announced winner(s) is/are responsible for contacting Picturehouse Cinemas within a week of such notification.

 

7. The announcement of the winner(s) will include contact details for the winner(s) to use in order to claim their prize.

 

8.In the event the announced winner(s) does not contact Picturehouse Cinemas within the deadline outlined above the company reserves the right to issue the prize to another entrant(s) and the original announced winner(s) will have no claim to any prize issued.


9. Picturehouse Cinemas will not be responsible for any inability of a prize winner to take up the specified prize.


10. Picturehouse Cinemas reserves the right to provide substitute prize(s) of similar value should the specified prize(s) become unavailable for reasons beyond its control. Cash or credit alternatives will not be offered. None of the prizes are transferable.


11. Picturehouse Cinemas accepts no responsibility for incorrectly completed, lost or delayed entries, notices, acceptances, tickets or other documents related to the prize(s). Incomplete, inaudible or illegible entries will be disqualified. Picturehouse Cinemas shall not be responsible for technical errors in telecommunications networks, internet access or anything else preventing entry to any competition.

 

12. In the event of fraud, abuse, and/or an error affecting the proper operation of this competition/prize draw, including the allocation of more prizes than are available, Picturehouse Cinemas reserves the right to end or suspend the competition/prize draw; amend these terms and conditions; declare void the notification of winner(s); and/or to allocate available prizes by conducting a simple draw from all wrongly allocated winners.


13. If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

 

14. The winner(s) may be required to participate in publicity connected with this competition/prize draw. It is a condition of entry that the winner(s) agree to their name and city of residence being made publicly available if they win.

 

15. Entrants' data will be collected, stored and processed for the purposes of administering and assessing this competition/prize draw.

 

16. Picturehouse Cinemas reserves the right to suspend, cancel or amend the competition/prize draw and/or review and revise these terms and conditions at any time without giving prior notice and by continuing to take part in the promotion subsequent to any revision of these terms and conditions, entrants shall be deemed to have agreed to any such new or amended terms.

 

17. This competition/prize draw is governed by English Law and is subject to the exclusive jurisdiction of the English courts.

These Conditions apply to the purchase and use of all Picturehouse Gift Cards, e-Gift Vouchers, Gift Membership Cards and e-Gift Membership Vouchers and other items made available for purchase on the Gifts page at Picturehouses.com from time to time (each a "Gift" and together "Gifts") and by purchasing a Gift  you agree to be legally bound by these Conditions. Additional terms may apply to some Gifts, such as Picturehouse merchandise, as detailed in the promotional materials for those products, and will form part of these Conditions. Use of Gifts is also subject to these Conditions and you're agreeing to be bound by these terms when you use a Gift. Picturehouse may amend or vary these Conditions from time to time at our sole discretion.

Gift Cards and e-Gift Vouchers

1. Gift Cards and e-Gift Vouchers are valid for use in Picturehouse Cinemas, online at www.picturehouses.com, on the Picturehouse app and phone booking line. The value on the Gift Card or e-Gift Voucher can be used towards payment for the purchase of cinema tickets, food and beverages. To use your Gift Card or e-Gift Voucher to make a purchase on the Picturehouse App or by calling the booking line, your Gift Card or e-Gift Voucher must have enough funds to cover the whole transaction. To use your Gift Card or e-Gift Voucher in person at our cinema or online on our website, Gift Cards or e-Gift Vouchers may be used as part payment towards the total cost of the transaction.


2. You may give the Gifts, Gift Card or e-Gift Voucher to anyone else to use but the Gift Card or e-Gift Voucher may not be re-sold. Please make sure that you and/or the recipient keep the Gift Card or e-Gift Voucher safe.


3. For transactions in Picturehouse Cinemas or online at www.picturehouses.com, where the value on the Gift Card or e-Gift Voucher is less than the total Transaction Value, the user will be required to make up the difference in price by any acceptable means including another Gift Card or e-Gift Voucher. No part payments using a Gift Card or e-Gift Voucher can be made on the Picturehouse App or ticket booking line.


4. Gift Card or e-Gift Voucher validity period: The Gift Card or e-Gift Voucher shall be valid for 24 months from the date of purchase. Once the entire balance has been used and no top-up has been made within 30 days from that date, the Gift Card or e-Gift Voucher will be deactivated and cannot be re-used. Any balance unused at the end of the validity period will be cancelled and no refund will be given.


5. When the Gift Card or e-Gift Voucher is used, the amount of the Transaction Value will be deducted from the balance on the Gift. The balance may be checked in our cinemas at any till point.


6. By purchasing a Gift Card or e-Gift Voucher you are expressly requesting that you and/or a User are able to immediately start using the Gift Card or e-Gift Voucher from the date of receipt of our email that confirms acceptance of your order.


7. When a Gift Card or e-Gift Voucher is used to purchase tickets online, a booking fee of £0.70 per ticket will usually apply, unless the User is a Picturehouse Member. Please see the Picturehouse Terms of Admission for further details about online bookings.


8. When a Gift Card or e-Gift Voucher is used to make a purchase via the Picturehouse App or the booking line, the User will need to collect their cinema tickets at their chosen Picturehouse Cinema by presenting the booking reference issued in the email from Picturehouse confirming completion of the transaction. Alternatively, where e-ticketing is available for a particular booking, the User may use the e-ticket attached to the email confirmation of booking ("e-ticket") as the cinema ticket in the chosen Picturehouse Cinema. Please see Condition 8 (Online Purchases) of the Picturehouse Website Terms of Use, within the Terms of Admission, for more details.


9. Gifts may not be exchanged for cash.


10. Defaced, illegible or photocopied Gift Cards or Gift Membership Cards will not be accepted.


11. The Gift does not entitle the User to have preferential treatment over other Picturehouse customers for the purchase of cinema tickets, merchandise, food and beverages, access to cinemas or otherwise.


12. The Gift does not entitle you to any credit or other form of financial accommodation.


13. Other taxes or costs may exist in relation to the Gift that are not imposed by us.

Gift Membership Cards and e-Gift Membership Vouchers 

14. There are two ways to give Picturehouse Membership as a gift, by purchasing a Gift Membership Card in cinema or an e-Gift Membership Voucher online at picturehouses.com/gift-shop. Picturehouse Cinemas Limited operates the Picturehouse Membership scheme and issues the Gift Membership Cards and e-Gift Membership Vouchers and their corresponding Voucher Codes.   Full details of the Picturehouse Membership Scheme are available here and the Picturehouse Membership terms and conditions can be viewed here.  


15. Gift Membership Cards 

  • The Gift Membership Card is a Gift Card issued by Picturehouse which has been credited with sufficient value to enable the User to purchase 12 months' Picturehouse membership (Membership) for the type of Membership selected at the time of purchase of the Gift Membership Card. 

  • The User can redeem the value on the Gift Membership Card at any Picturehouse cinema, during the card's validity period, to purchase a 12 month fixed term Picturehouse Membership for themselves. The Gift Membership Card may not be redeemed for Membership online. The User would be required to make a supplementary payment at the time of redemption of the Gift Membership Card if the price of the relevant 12 months' Membership chosen is greater than the amount credited to the Membership Gift Card (for example if the price of the relevant Membership has increased since the date of purchase of the Membership Gift Card or if the User chooses a more expensive type of Membership than the type of Membership gifted). 

  • As the Gift Membership Card will be credited with a specific value rather than a credit for a specific Membership, the Gift Membership Card may be used to purchase cinema tickets, food and drink instead of Membership if preferred and the terms and conditions for Gift Cards will apply to the Gift Membership Card (except that a Gift Membership Card may only be redeemed in cinema and not online).  

     

16. e-Gift Membership Vouchers

  • The e-Gift Membership voucher is a voucher which can be purchased online at picturehouses.com/gift-shop and redeemed on the Picturehouse website for a pre-paid 12 month fixed term Picturehouse Membership (Membership) for the type of Membership selected at the time of purchase of the e-Gift Membership voucher. e-Gift Membership vouchers are only available for purchase online.  

  • To redeem the e-Gift Membership voucher the User must enter the code and pin number stated on the e-Gift Membership voucher at memberships.picturehouses.com/subscription. 

  • e-Gift Membership voucher cannot be used in conjunction with any offer or discount and cannot be redeemed against any other goods or services.

17. The purchaser of the Gift Membership Card or e-Gift Membership voucher may give it to someone else or use it themselves.  

18. The person who redeems the e-Gift Membership voucher or Gift Membership Card for a Membership must be eligible to sign-up for Membership. This means they must be aged 16 or over and resident in the UK or Republic of Ireland and any other eligibility criteria relevant to the type of Membership purchased.  

19. When redeeming the e-Gift Membership voucher or Gift Membership Card and completing the Membership sign-up process, the User must create a My Picturehouse account (if they don't already have one), provide their name, date of birth and email address and agree to the Picturehouse Membership Terms and Conditions.  They'll also be asked to confirm they have read the Picturehouse Privacy Policy.  The Membership will start when the User has redeemed the e-Gift Membership voucher and successfully completed the Membership sign-up process.  

20. The e-Gift Membership voucher or Gift Membership Card will be valid for 24 months from the date of purchase. Once the e-Gift Membership voucher or Gift Membership Card has been redeemed in full, it will be deactivated and cannot be re-used or redemption reversed. e-Gift Membership vouchers or Gift Membership Cards purchased from third parties may have different validity periods and/or a fixed expiry date. 

21. e-Gift Membership Vouchers and Gift Membership Cards can only be redeemed during their validity period. If the e-Gift Membership Voucher or Gift Membership Card has not been redeemed during the validity period, it will be cancelled and no refund will be given. 

22. Gifts, Gift Membership Cards, e-Gift Membership Voucher and the corresponding codes cannot be exchanged for cash. 

23.Gifts, Gift Membership Cards, e-Gift Membership Vouchers and their corresponding codes are for personal non-commercial use only and cannot be resold or shared in exchange for any value or benefit.

24. Picturehouse may close or suspend the Picturehouse Membership scheme at any time and for any reason on not less than 30 days' notice in writing to you and/or by posting a notice online at picturehouses.com. If the Picturehouse Membership scheme is closed: 

  • e-Gift Membership Vouchers cannot be used even if they are still in their validity period (any applicable refund for will be paid to the purchaser) 

  • the balance on any Gift Membership Cards may still be used to purchase tickets, food and drink at Picturehouse cinemas (but not Membership).

     

     

Changes to Picturehouse Cinemas 


25. The number, location and availability of Picturehouse Cinemas in any area are subject to change. A list of current Picturehouse Cinemas is available from www.picturehouses.co.uk or on written request to the Customer Services Department.

 

Cancellation rights

26. You may cancel your purchase of any Gift you have bought online from picturehouses.com and claim a refund at any time up to fourteen (14) calendar days starting from the day after you receive our email confirming acceptance of your order (the "Cancellation Period"). If the Gift Card or e-Gift Voucher has been used before your cancellation has been processed, you will only receive a refund of the balance remaining on the Gift Card or e-Gift voucher at that time. Cancellation of a Gift Membership Voucher will not be possible if it has been redeemed before your cancellation has been processed and no refund will be issued. The premium paid for postage of any Gifts and Gift Cards will be deducted from the amount refunded to you.

27. If you wish to cancel your purchase of a Gift, please write to, email or call the Customer Services Department stating the Gift or Gift code and your wish to cancel.

28. Once the Cancellation Period has expired, you will not be able to cancel your purchase of the Gift or claim any refund in that respect.

29. These cancellation rights do not apply to purchases of Gifts made in cinema. 

 

Defective, lost or stolen Gifts

30. If the Gift Card or Gift Membership Card is defective, you must return it to the Customer Services Department as soon as possible in order to receive a free replacement.

31. If the e-Gift or Gift Membership Voucher code does not work, you must contact the Customer Services Department by phone or email as soon as possible so the Voucher code can be cancelled and a new Voucher code may be issued to you. Our liability in such cases is limited to replacement of the defective Gift Card/Gift Membership Card or issue of a new Voucher code to the same value of the outstanding balance on the original Gift at the time of replacement.

32. Where items need to be returned, these must be returned to us in a resalable condition. Where applicable, this means unworn and unused, in the same condition you received them and with any labels and packaging intact. We will review your return upon receipt and we will issue a refund/exchange in 10 business days.

33. Postage costs cannot be refunded, and the Customer will be responsible for return shipping costs, unless the Gift is defective or incorrect.

 

Questions and complaints

34. Any questions or complaints you may have in relation to any Gift should be directed to the Customer Services Department.

35. No other out-of-court complaint or redress system or compensation scheme exists in relation to Gifts. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to use alternative dispute resolution.

 

Liability

36. Except as expressly provided in the Conditions, all warranties, conditions or other terms in favour of you or the User implied by Statute or common law are excluded to the fullest extent permitted by law.

37. Nothing in the Conditions is intended to limit our liability for fraud or death or for personal injury caused by our negligence, or shall it be construed to do so.

38. We shall in no circumstances be liable if one or several Picturehouse Cinemas is/are closed permanently or temporarily or if a Picturehouse website is unavailable for whatever reason, or if a particular film or item of merchandise, food or beverage is unavailable for whatever reason.

39. We shall not be liable to you or the User by reason of any failure or delay in performing any of our obligations in relation to any Gift under the Conditions if the failure or delay was due to any cause beyond our reasonable control.

40. We shall not be liable to you or the User in respect of any indirect or consequential loss, damage, costs or expenses or other claims for consequential compensation whatsoever which arise out of or in connection with any Gift.

41. Our liability to you and the User shall not exceed the amount paid by you for the Gift.

42. We shall not be liable to you or the User in the event of loss, theft, unauthorised use or re-sale of any Gift and we will not issue any replacements unless the fault was ours.   

 

Governing Law and Jurisdiction

43. We will only write and communicate with you in English.

44. English law governs these Conditions and all aspects of our relationship including your purchase and use of a Gift.

This website (www.picturehouses.com) and the app (Picturehouse iOS App and/or Picturehouse Android App)  are owned and operated by us (each and together referred to in these terms and conditions simply as our "Sites").

2. APPLICATION OF THESE TERMS & CONDITIONS

  1. These terms and conditions, together with our Privacy Policy, Cookies Policy and Terms of Admission (which include our Terms of Use) and our Terms & Conditions
  2.  govern the way in which you may use our Sites and they apply to your Picturehouse Membership (referred to in these terms and conditions simply as Membership), Membership cards (plastic and virtual) and all orders you place on our Sites irrespective of the delivery platform or device you use to access it. These membership terms and conditions do not apply to Picturehouse's clubs and groups which are free of charge, such as Silver Screen or Watch with Baby.

  1. Please read these terms and conditions carefully and make sure that you understand them before applying for a Membership (you may wish to print a copy for your records). By accessing our Sites you are agreeing to these terms and conditions but they do not affect your statutory legal rights. If you do not agree with the terms and conditions you should not apply for a Membership, use our Sites or place an order.
  2. If you think there is a mistake in these terms and conditions or you have any questions, then please contact the Membership Helpline to discuss.
  3. We may occasionally amend these terms and conditions and you should check them each time you place an order. These terms and conditions were last amended on 23rd January 2025.
  4. You are only eligible for a Membership if you are aged 16 or older and are resident in the UK or Ireland. By submitting an order you are promising to us that you are at least 16 years old. We may at any point ask for proof of your age.

3. TYPES OF MEMBERSHIP

We offer different types of Membership:

  • Individual Membership
  • Member Plus
  • Student Membership

As well as an upgrade to Premium Membership for Individual and Plus members on renewal in certain circumstances (referred to as the 'Premium upgrade' or 'Premium membership') (please see clause 12 for more details about the premium upgrade).

The benefits of these different types of Membership are detailed in clause 7 below. When you purchase a Membership, you will select a Membership category which will determine the cinemas at which you can use your free tickets and may also give you access to certain other offers and benefits specific to cinemas within your chosen category from time to time. If you sign up for Membership using an e-Gift Membership Voucher, you can only select the type of Membership for which the e-Gift Membership Voucher is valid. The locations and cinemas currently available which can be associated with each type of Membership are as follows:

4. APPLYING FOR MEMBERSHIP

  1. You may apply for a Membership by completing the application form and making payment on our website or subscribing at the kiosk in a Picturehouse Cinema. You may not apply for a Membership for anyone other than yourself.
  2. All membership periods are for 1 year (although some will automatically renew), with Membership fees payable for the full year in advance.   
  3. There are two different payment options for your Membership:
    • Recurring annual subscription where your Membership will automatically renew each year for further periods of one year (Membership fees will be charged to your saved payment card) unless and until cancelled (see cl 10 below for more details).  Only available for purchase online on the website; or
    • One off payment for a 12 month Membership which will not automatically renew, although you may renew online through your MyPicturehouse account during the last month of your current membership period (please see clause 11 for further details). First year of Membership available for purchase online and in Picturehouse cinemas (renewals are online only). Gift Membership Cards and e-Gift Membership Vouchers may be redeemed/ used to pay for these 12 month fixed term Memberships but not recurring annual subscriptions.  
  4. Up until the point at which you place an online order, you can review it and make changes to it. Please take the time to check your order before submitting it. If you submit an order in error, you will have the opportunity to cancel this as detailed in clause 5.
  5. When placing an order you must provide us with complete and accurate payment information. By submitting payment details you promise that you are entitled to place the order and purchase Membership from us using those payment details. If we do not receive payment authorisation or any payment authorisation is subsequently cancelled, we may immediately terminate or suspend your access to your Membership. In suspicious circumstances we may contact the issuing bank/payment provider and/or law enforcement authorities or other appropriate third parties.
  6. We are not obliged to accept your order and can refuse to do so for any reason. We may also be unable to accept your order because:
    • we have identified an error in the price or description of our services;
    • we are unable to obtain authorisation for your payment;
    • you do not meet the eligibility criteria as set out in these terms and conditions.   
      We will let you know if this is the case and will not charge you for the Membership you have attempted to order.
  7. If you have applied online and your application is accepted, we will send you a confirmation email and issue your virtual Picturehouse Membership Card within your MyPicturehouse account (accessible via our website and the App). No physical plastic card will be issued to you.
  8. If you have applied for Membership in a Picturehouse Cinema and your application is accepted, we will issue you with a physical Membership card and, where you have provided your email address, send you a confirmation of purchase email (to the email address you provide during the sign up process) confirming receipt of your order.
  9. The creation of an agreement between you and us for the Membership you register for will only occur when we confirm acceptance of your application and issue you with your Membership card.
  10. You understand that by purchasing a Membership you are committing to pay the full annual subscription fee in advance for that Membership for the period of 12 months (subject to these terms and conditions).
  11. No refund of the annual subscription fee for the period which is paid in advance will be made unless you cancel in accordance with clause 5 below or we are in breach of these terms and conditions in which case clause 16 applies.
  12. To purchase and use a Picturehouse Student Membership, a valid student ID is required and may be requested at any time.

MyPicturehouse Account

  1. Please note that as part of the order process (whether online or at a Picturehouse Cinema) you will be asked to register a Member's account called a "MyPicturehouse account" with us and registration is for a single user only. Where you have been issued with a physical Membership card (see clause 4) you will need to activate your Membership via your MyPicturehouse account in order to access the full benefits of your Membership. On registration, you will be asked to choose a user name and password (this will be your "ID") this is personal to you. The email address that you provide must correspond to a named email account and not a generic or shared email account.
  2. You must not share your ID or give access to your MyPicturehouse account through your ID to anyone else. We may suspend or cancel your account and terminate the agreement and your Membership if you share your ID without our consent.
  3. You are responsible for all use of your Membership whether by you or anyone else who is using your ID and you must prevent unauthorised use of your ID.
  4. If you believe there has been any theft or unauthorised use of your ID, your virtual Membership card or any payment information, you must notify us immediately by calling the Membership Helpline on 0207 733 2229 or via [email protected] and immediately change your password by using the 'Forgot your password?' function on our website.
  5. We recommend that you change your user password regularly. Changes to your ID can be made by logging in to your "Manage My Account" section of your MyPicturehouse account.
  6. Picturehouse may make changes to the Sites, online ticket booking functionality, My Picturehouse and account management functionality at any time and without notice.  If You are unable to book tickets via the App and/or Website for any reason, but You can still use your physical or virtual Membership Card in-cinema and display it to validate your admission to the cinema, then your Membership will be deemed active and no refund or other compensation in connection with the virtual Membership card or the online booking function will be available.
  7. When your Membership ends, your virtual Membership Card will be deactivated but your MyPicturehouse account will remain active and you will be able to continue using it to enjoy the benefits of your free MyPicturehouse account.

5. CANCELLATION RIGHTS

  1. If you applied for your Membership online via our website, you may cancel the Membership at any time within the next 14 days following the start of your Membership (as referred to in clause 4 above). This period is known as the cancellation period.
  2. Where your Membership has automatically renewed or you have renewed it yourself, You may cancel your Membership within the next 14 days after the date of renewal.  This period is also known as the cancellation period.
  3. To cancel, you will need to contact the Membership Helpline by phone, or in writing by email or post, and let us know of your decision to cancel or you can use our template cancellation form (please request one by emailing [email protected]) within the cancellation period.
  4. If you cancel in accordance with this clause 5 you will receive a full refund of any Membership fee you have paid for your Membership (or Membership renewal as appropriate) although, if you visit Picturehouse cinema(s) before your Membership is cancelled, you will be charged and must pay for any Member free tickets used, discounts and benefits enjoyed and/or other costs incurred by us arising from the visits to the cinema by You during that time, in which case the amount refunded will be reduced accordingly and, in certain circumstances, could mean that no refund is due.
  5. Refunds will usually be paid back to the credit, debit or charge card used to purchase the Membership (or such other method as we may need to use, such as BACS transfer) within 14 days of receipt of your request to cancel.
  6. If you signed up for your Membership using an e-gift Membership Voucher your Membership fee has been paid by someone else so you don't have a right to cancel your Membership and receive a refund under this Clause 5.

6. MEMBERSHIP DISCOUNTS AND OFFERS

  1. In order to claim the Membership food and beverage discounts (see clause 7 below), you must show your valid Membership card at the appropriate Picturehouse Cinema kiosk or bar or where the relevant discount or offer is available via our Sites, by inputting the relevant details on our website or App as directed.
  2. To claim the Membership discounts on the Picturehouse booking line, you will need your Membership number and will be required to pass security to access your account.
  3. We may occasionally make additional discounts and offers available to Picturehouse Members. The additional discounts and offers made available to Members are discretionary and may be withdrawn or amended at any time without notice. You will need to show your valid Membership card to claim these additional discounts and offers and they may also be subject to time restrictions, availability and other terms and conditions.
  4. To avoid disappointment, please ensure you check the terms and conditions for a promotional offer before trying to redeem it.
  5. We are not responsible for promotions related to our services where such promotions are published on external websites or other media.

7. FREE TICKETS, DISCOUNTS AND USING THE MEMBERSHIP CARD

A valid Membership card entitles the holder to:
  1.  discounted tickets at every Picturehouse Cinema (discounts will be as detailed on the website at the time of ticket purchase and will apply to the member's ticket only) although the discount cannot be used in conjunction with other reduced price ticket types or screenings such as promotional tickets (eg. U25), family tickets, Silver Screen, Relaxed Screenings or exclusive-audience screenings, for example, Kid's Club, Toddler Time and Watch with Baby); and
  2. free tickets every Membership year as follows:
    • Picturehouse standard Membership includes five free tickets;
    • Picturehouse Membership Plus includes ten free tickets;
    • Picturehouse Student Membership includes two free tickets; and
  3. discounts on food and beverages purchased in every Picturehouse Cinema as follows:
    • Picturehouse Student Membership: 25% discount; and
    • Picturehouse standard Membership and Picturehouse Membership Plus: 10% discount (unless you have been upgraded to Picturehouse Premium Membership, in which case you will receive 20% discount).

    Additional benefits of Membership Plus

  4. If you are a Membership Plus Member, you will have the following additional benefits:
    • You will be entitled to bring up to three guests to any performance, each of whom will receive the same discount on the price of tickets as you for that performance(discount not available on child or family tickets); and
    • Where you have been given an additional Membership card to share with a friend or family member (only available for Member Plus purchases made in cinema), this additional card will be linked to your Membership and will cease upon expiry of your Membership. You are forbidden from charging a fee for the use of this additional card and if you do we may cancel your Membership.

    Free Tickets

  5. Free tickets cannot be used for premium priced screenings and special events (such as Screen Arts and Q&As), and a 3D supplement may be payable on any 3D films unless you have been upgraded to Picturehouse Premium Membership (see clause 7(15) below).
  6. The free tickets can only be used in the following categories of Picturehouse Cinemas depending on the Picturehouse cinema category which is associated with the Membership:
    • West End category: all Picturehouse Cinemas;
    • London category: all Picturehouse Cinemas except Picturehouse Central;
    • Outside of London category: all Picturehouse Cinemas outside London
  7. Members may book their free tickets in advance (either online through their MyPicturehouse account or in person at the category of Picturehouse Cinema which is included in their Membership) for programmed performances.
  8. Free tickets will only be valid whilst you have a current and valid Membership.

Food and beverage discounts

  1. The discount on food and beverages is subject to exclusions of any other promotions and special offers which may apply to those purchases at that time and is for the named Membership cardholder only and available only on production of a valid Membership card. The discount is not applicable to group bills or party bookings. The manager's decision is final.

Booking tickets and claiming discounts

  1. To use the Membership card in the Picturehouse Cinema (whether to book tickets or to use any of the other benefits associated with Membership), the Member must present it at a Picturehouse Cinema Kiosk or bar. The Membership card will be scanned to check its validity, and additional identification may be requested. If the Membership card is validated, the Member will be issued with the ticket for the chosen screening and time subject to availability or granted the applicable benefit or discount. If the Membership card is not validated, the Picturehouse Member may be advised to contact the Membership Helpline and no tickets or other benefit will be available until the Membership card is validated.
  2. Your Membership card is not transferable or for sharing.
  3. All film screenings are subject to normal restrictions such as age certifications, and to Picturehouse Cinemas' Terms of Admission. The Member shall have no preferential rights of access to any screenings, except special screenings organised for Members.
  4. The Membership card must be shown when the tickets (including e-tickets) are checked before entering the relevant auditorium. Entrance will not be permitted without the Member presenting the Membership card.

 

Displaying your Membership Card

  1. Where you are required to display your Membership card at the cinema, for example to claim Member discounts and offers, you may show your physical Membership card (if you have one) or your virtual Membership card on your mobile device:
    • By logging in to your MyPicturehouse Account on the website and clicking "View card" in the Overview section of your account; or
    • on the App, by tapping the menu button in the top left of the screen and then tapping the QR code then displayed in the top left. 

 

Additional benefits if you are upgraded to Premium Membership

  1. If you have standard Membership or Membership Plus and you have been upgraded to Premium Membership (please see clause 12 below), you will receive the following additional benefits:
    • no upgrade fees or additional charges for 3D films (although a charge may be payable for the purchase of 3D glasses);
    • 20% off food and beverages purchased in every Picturehouse Cinema    

Founder Membership Offer

  1. Sometimes, when we open a new cinema, we offer a limited number of Founder Memberships to the first cohort of new members who sign up for Picturehouse Membership and choose that cinema as their Home Cinema. Founder Membership includes all of the usual benefits of regular Membership (depending on the Membership type selected) plus those extra Founder Member benefits as advertised on the Picturehouse website or blog at the time of purchase.
  2. Founder Memberships are made available at Picturehouse's discretion, are limited in number and may be withdrawn or amended at any time without notice prior to purchase.
  3. Where your Founder Membership benefits include the opportunity for your name to be included on the Founder Members' Wall (the "Wall"), your name (or abbreviated form), as written on your Membership application, will be included on the Wall unless you tell us that you do not want your name to be included on the Wall (opt-out) prior to the artwork being created. We will contact you by email after your purchase, once the full quota of new members have joined the relevant new cinema, to let you know how you can opt-out and the last date for submitting your opt-out to us.  Please note, opt-outs received after this date may not be accepted as once the Wall artwork has been created we may not be able and are not obliged to change it.
  4. The Wall will be a specially commissioned, striking piece of artwork displayed within a public area of the cinema. All elements of the Wall design, any changes and choice of when and where to display within the cinema will be at Picturehouse's sole discretion. The Wall will only be created once we have the full quota of names for the Wall, which may take a number of months after the new cinema has opened.

 

8. PAYMENT OF ANNUAL MEMBERSHIP FEES

    1. The annual Membership fee for each type of Membership is available from our website, Picturehouse Cinemas and the Membership Helpline or notified to you during the Membership application process and includes VAT. If the rate of VAT changes between your order date and the date we supply our services, we will adjust the rate of VAT that you pay, unless you have already paid for the Membership in full before the change in the rate of VAT takes effect.
    2. The annual Membership fee must be paid in advance at the same time as applying for or renewing Membership.
    3. Payment can be made online using a debit, credit or charge card or  PayPal, or by redeeming an e-Gift Membership Voucher (but not Picturehouse Gift Cards or e-Gift Vouchers). We accept these payment methods in cinema as well as payment using Picturehouse gift cards and e-Gift vouchers. We accept all major credit or debit cards, including VISA, Mastercard and American Express. 
    4. Payment for Recurring Annual Subscriptions may only be made using debit, credit card or American Express (not PayPal or other payment method) as you'll be providing continuous payment authority, with permission for us to charge your payment card for your membership fees each year when your Membership automatically renews.
    5. During the checkout process (if you are applying online) you will be asked for your payment details. By completing these you are confirming that the bank account information / debit or credit card/PayPal account ("Payment Card") is yours and you are authorising us to charge you the relevant Membership fees at the then current rate to your Payment Card.
    6. All payments are subject to authorisation by your card issuer or by PayPal when you pay using your PayPal account.
    7. To make any payment by credit, debit or charge card, you must provide the cardholder's name and email address, the card number, the card security code, the card expiry date and (where applicable) the card start date and/or issue number.
    8. We reserve the right to increase the annual Membership fee but this will not affect any order you have already placed and which we have accepted for the relevant Membership period before the increase took effect.  The increased fee will apply to your next Membership renewal, and details will be available from the website.
    9. We make every effort to ensure that the correct prices are displayed on our website. However, if we realise services have been given the wrong price, we will correct this without delay.
    10. If we discover an error in the price of the Membership or any other services you have ordered before they are provided to you, we will contact you to inform you of this error and will give you the option of continuing to purchase at the correct price or cancelling your order. If we are unable to contact you, we will treat the order as cancelled and notify you accordingly.
    11. Please note that if a pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing, we do not have to provide our services to you at the incorrect (lower) price.

9. AUTOMATIC RENEWAL IF PAYING BY DIRECT DEBIT (NOT AVAILABLE FOR NEW MEMBERS)

    1. If you choose to make continuous payment by Direct Debit with your bank, your Membership subscription will automatically continue at the end of your Membership period and the Membership period will be extended for a further year unless you notify us you do not wish to renew.
    2. We will notify you at least 30 days in advance of your next renewal period to remind you that your current membership period will soon be expiring and let you know any changes to your Membership fee that will apply upon next renewal.
    3. If you want to change the bank account to be debited, you may telephone the Membership Helpline to provide the new Direct Debit details. You will need to cancel your old Direct Debit instruction directly with your bank. You must give us at least three (3) weeks to process these changes.
    4. If you don't want your Membership to automatically renew, you must let us know at least three (3) weeks before the end of your Membership period by contacting the Membership Helpline by phone or in writing by post or email (sent from the email address associated with your My Picturehouse account). 
    5. You may also cancel your Membership within the first 14 days after each annual renewal of your Membership, as detailed in clause 5 (Cancellation Rights) above.

10. AUTOMATIC RENEWAL OF ONLINE MEMBERSHIPS

      1. Where you pay for your Membership using the Recurring Annual Subscription option, your Membership will automatically renew at the end of each 12 month Membership period, your Membership fees will be charged to your Payment Card on or within three (3) days of the renewal date, and the Membership period will be extended for a further year unless you notify us in advance that you do not wish to renew. You authorize Picturehouse to charge Membership Fees and any other sums payable by you under these Terms to your Payment Card.
      2. We will notify you at least 30 days in advance of your next renewal period to remind you that your current membership period will soon be expiring and let you know  the Membership fee that will apply upon next renewal.
      3. As your Membership Fees will be payable annually by recurring credit, debit or charge card payment, you must have a valid Payment Card associated with your Membership at all times.  You may change the Payment Card to be debited by updating the Payment Card details in your My Picturehouse account.
      4. If you don't want your Membership to automatically renew, you may cancel the renewal of your membership either:
        • through your My Picturehouse account, by clicking the 'cancel' button and following the steps on screen (where functionality is available); or
        • by contacting the Membership Helpline by phone or in writing by post or email (sent from the email address associated with your My Picturehouse account)    Please ensure you let us know using one of the above methods at least 5 days before the end of your current Membership period, to avoid being charged for your next renewal.  
      5. You can also cancel your Membership within the first 14 days after each annual renewal of your Membership, as detailed in clause 5 (Cancellation Rights) above.
      6. Payments for Membership Fees for renewals will start processing three (3) days in advance of your payment due date. If any card payment is rejected or otherwise unsuccessful (including due to inaccurate or outdated Payment Card information), Picturehouse will make a maximum of five attempts to charge your Payment Card to take payment. If our attempt(s) to take payment are unsuccessful, Picturehouse may notify you and your Membership will automatically terminate on the renewal date.  After that time, you may apply to purchase a new Membership via your My Picturehouse account, although the upgrade to Premium Membership will not be available during the first year of your new Membership. 
      7. If You cancel automatic payments from your Payment Card, Picturehouse may cancel your Membership without refund.
      8. Picturehouse may charge you, and you are responsible for, any and all outstanding Membership Fees and any expenses reasonably incurred by Picturehouse in connection with your unpaid Membership Fees.

 

11. RENEWAL 12 MONTH ONLY MEMBERSHIPS

        1. Where your Membership is for 12 months only (One Off Payment), your Membership will last for one year only and will not automatically renew.  
        2. We will send you some renewal reminders by email during the last six weeks of your 12 month Membership period.
        3. You may renew your Membership at any time during the last month of your current Membership period. Renewals may be purchased online through your MyPicturehouse account by clicking the 'Renew' button in your MyPicturehouse account and following the steps on screen. The fees for your next 12 months of membership will be displayed in the onscreen renewals process and will also be available in advance from the website. 
        4. It is not possible to renew your Membership in our cinemas or by phone (even if you purchased your initial Membership in cinema). 
        5. If you renew before the end of your current Membership period, your Membership will start the date after your current Membership expires and you'll qualify for the upgrade  to Premium Membership (see clause 12 below).  If you renew after your old membership has expired, your new membership will start straight away but you won't receive the benefits of the Premium Membership.

 

12. UPGRADES TO PICTUREHOUSE PREMIUM MEMBERSHIP AND OTHER OFFERS

    1. We will automatically upgrade your standard Membership or Membership Plus  (but not your Student Membership) to Premium Membership (at no extra charge) if your Membership continues after your first year provided that the Membership fees for the renewal period have been paid before expiry of your first Membership year. This means you will continue to enjoy the benefits of your Standard Membership or Membership Plus with the extra benefits of Premium Membership (please see clause 7(15) for more details). As long as you keep renewing before your Membership expires, this upgrade to Premium Membership will also apply to every Membership year after this year. If you cease to be a Member and you wish to become a Member again, you will need to purchase a standard Membership (or Membership Plus) for one year before you will be entitled to an upgrade to Premium Membership again.
    2. We may also make other offers available to you at the date of renewal (or otherwise) but such offers are discretionary and may be withdrawn or changed by us from time to time. Details of current offers (if any) will be published on our website.

13. LOST, STOLEN OR DEFECTIVE CARDS

    1. You will need to telephone the Membership Helpline as soon as possible to report any lost or stolen physical Membership card or unauthorized access to your My Picturehouse account or virtual Membership card and follow the steps advised by the Membership Helpline to secure your account.  If you need to replace your current physical card, you will be able to collect a replacement card at any Picturehouse Cinema, if you can answer certain security questions (for example, your name and membership number) to allow staff to access your account.  Alternatively, you may use your virtual Membership card located in your MyPicturehouse account and display on your mobile device.  No physical cards will be issued to Members who signed up for Membership online.    
    2. For the avoidance of doubt, no refunds will be given for cinema tickets purchased by you between the date the card was lost, stolen or damaged or a replacement card was requested and the date you receive your new physical Membership card.
    3. We may charge an administration fee for each replacement physical Membership card we have to issue.  You can also access a digital version of your Membership card in the Picturehouse App.

14. CHANGES

    1. We may make minor changes to these terms and conditions from time to time to correct errors, to clarify terms, to comply with any law or regulation that applies to us, or to update these terms and conditions to reflect changes to the way our systems work or enhancements to the Membership scheme. You will not be specifically notified of such changes, but they will be on our website. To see the most up-to-date version of these terms and conditions, please always check our website. No such changes shall disadvantage you or a Picturehouse Member.
    2. Additionally, we reserve the right to make other more material changes to these terms and conditions in which case we will notify you of the change by contacting you using the details you have provided. This will usually be by email but we may contact you using a different method of communication, for example by post. If these changes are to your disadvantage, you may terminate your Membership within 30 days from the date we have notified you of the changes. In order to do so you must notify us in writing of your request to terminate, stating the reason for termination. Following receipt of your termination notice we will refund the Membership fee paid by you after deducting an amount equal to the value of the use of the Membership Card by you prior to the termination date. Refunds will be paid back to the credit, debit or charge card or other method of payment used by you in purchasing the Membership (or such other method as we may need to use, such as BACS transfer) as soon as reasonably practicable. On termination, we will deactivate your Membership card.

15. INFORMATION PROVIDED

    1. You confirm that the personal information you provide that identifies you (including contact information) is accurate and complete, and that you are authorised to provide such personal information. It is your responsibility to ensure that such personal information is kept up to date, and we will not be responsible for matters arising from errors or omissions in personal information at any time. You may update your own details at any time online via your MyPicturehouse account (where the relevant function is available) or by contacting the Membership Helpline.
    2. We will use your personal information in accordance with the Picturehouse Privacy Policy. The Privacy Notice contains more detail about how we collect and use your personal information and you should read it carefully and make sure that you understand it before applying for Membership.
    3. When communicating with you, we will use the contact information (email address and phone numbers) provided in your MyPicturehouse account. It is therefore important that you keep your contact details updated.

16. ISSUES WITH YOUR MEMBERSHIP

    1. We promise to provide the Membership services to you with reasonable skill and care and to use reasonable efforts to promptly remedy any faults of which we become aware. However, we do not provide any other promises or warranties about Picturehouse Membership, our website or services.
    2. You have the right to terminate your Membership where:
      • we have told you about an error in the price or description of our services you have ordered and you do not wish to proceed;
      • we have notified you that there is a risk that supply of our services may be significantly delayed because of events outside our control;
      • we have suspended or have notified you that we are going to suspend supply of our services for technical reasons for a period of more than 14 consecutive days; or
      • where we have failed to comply with these terms and conditions in a serious way and we are unable to cure such failure within a reasonable time period.
    3. If you wish to terminate your Membership for any of the reasons detailed in this clause 16 please notify us by e-mailing us or writing to us at the contact details provided at picturehouses.co.uk/contact. Your Membership will end and your Membership card will be de-activated and invalidated as soon as we receive your notification and process your request, and we will refund you in full the Membership fee you have paid less a deduction for the price of any use you have made of your Membership up to and including the date of your termination notice. If you signed up for your Membership using an e-Gift Membership Voucher, someone else has paid for your Membership so you won't receive a refund. 

17. YOUR LEGAL RIGHTS

As a consumer, you have legal rights in relation to services that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau. Nothing in these terms and conditions will affect these legal rights.


18. SUSPENSION AND TERMINATION BY PICTUREHOUSE

    1. We may suspend your Membership and temporarily deactivate your Membership Card or terminate your Membership (in our discretion) if:
      • you fail to make any payment to us when due;
      • we suspect any fraud in any matter connected to your Membership;
      • any significant misuse of your Membership or Membership card;
      • you breach any of our Terms of Entry or you engage in any behaviour or activity that is disruptive to or damaging to any Picturehouse Cinema;
      • any other serious breach of these terms and conditions which is either not capable of cure or which (if capable of cure) is not cured by you within the reasonable time period we specify.
    2. If we terminate your Membership under this clause 18, we may refund any Membership fee you have paid but shall be entitled to deduct the price of any services you have used since the start of your Membership and a fair amount to reflect the loss to us from terminating the Membership in such circumstances. This right does not limit any other rights we may have against you.
    3. On termination, we will deactivate and invalidate your Membership card.
    4.  We may close or suspend the Picturehouse Membership scheme at any time and for any reason on not less than 30 days' notice in writing to you and/or by posting a notice online on the Picturehouse website.  If the Picturehouse Membership scheme is closed in this way, we will refund the Membership fee paid by you after deducting an amount equal to the value of the use of your Membership by you prior to termination.

19. OUR LIABILITY

    1. If we fail to comply with these terms and conditions, we are responsible for any loss or damage that you suffer that is a foreseeable result of us breaking this agreement or failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable either if it is obvious that it will happen or if at the time of your application both you and we knew it might happen.
    2. Please note though that Picturehouse cinemas may be closed on a permanent or temporary basis from time to time, including for refurbishment or due to an event outside our control (as described below). We do not accept any liability for loss or damage in these circumstances. Details of such closures can be found on our social media channels or by calling the Membership Helpline.
    3. We will not be liable or responsible for any failure to perform or delay in performance that is caused by events outside of our reasonable control, including any act, event, non-happening, omission or accident which may be due to the following:
      • Strikes, lockouts or other industrial action
      • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war or threat or preparation for war
      • Fire, explosion, adverse weather, snowfall, ice, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster
      • Disruption to or failure of the railways, shipping, aircraft, motor transport or other means of public or private transport
      • Disruption to or failure of public or private telecommunications networks, the Internet, utility supplies or postal services
      • Closure of or limited access to Picturehouse Cinemas on the grounds of our reasonable health and safety concerns
      • Any governmental act, decree, legislation, regulation or restriction
    4. We do not exclude or restrict our liability for fraud, or for death or personal injury resulting from our negligence or that of our contractors or agents, and nothing in this clause shall operate to exclude, restrict or limit this liability.
    5. This agreement is between Picturehouse and you and no other person shall have any rights to enforce this agreement.
    6. If we do not insist that you perform any of your obligations under these terms and conditions, or do not enforce or delay enforcing our rights, that will not mean that we have waived our rights nor that you do not have to comply with those obligations unless we have confirmed this in writing to you.
    7. English law governs these terms and all aspects of the relationship between us and you, The English courts shall have non-exclusive jurisdiction to hear any dispute or claim arising out of or in connection with these terms and conditions. This means you may bring a claim to enforce your consumer protection rights in connection with these terms and conditions in England or in the country in which you live.
    8. We will only write and communicate with you in the English language.

20. QUESTIONS AND COMPLAINTS

    1. All complaints or queries should be addressed to the Customer Care Team by post (c/o The Ritzy, Brixton Oval, Coldharbour Lane, London SW2 1LG) or by email ([email protected]) or by phone (0207 733 2229).
    2. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to use alternative dispute resolution.

These terms and conditions (Terms) apply to your registration for and use of any MyPicturehouse account in all respects including any ticket bookings you make through a MyPicturehouse account (whether accessed via th Picturehouse website or App). Please read them carefully and check our Website regularly for any updates to these terms. 

 

  1. To register for a MyPicturehouse account you must be resident in the UK and aged 16 years old or over. You may only have one MyPicturehouse account at any time.
  2. In addition to the following MyPicturehouse account terms, the Picturehouse Website Terms of Use and the Picturehouse Privacy Policy apply to  your registration for and use of a MyPicturehouse account.  If you book tickets through your MyPicturehouse Account the Terms of Admission and other Picturehouse Terms and Conditions will apply as appropriate. If you are a Picturehouse Member and you use your MyPicturehouse account in connection with your membership, the Picturehouse Membership terms will also apply.
  3. On registration for a MyPicturehouse Account, you will be asked to provide your name, email address, postcode and date of birth. You will also need to choose a user name and password (this will be your "ID"); this is personal to you. The email address that you provide must correspond to a named email account and not a generic or shared email account.
  4. You may also provide your phone number and home address and subscribe to our marketing emails when registering for your account. You can update your contact details, ID and marketing preferences at any time after registration by logging in to the "Your Account Details" section of your MyPicturehouse Account.   
  5. Picturehouse will use your personal information provided during the registration process and in your MyPicturehouse account to provide the MyPicturehouse facilities, functions and services and, where relevant, the benefits of any memberships you may have with us such as your Picturehouse Membership or membership of U25. Our Privacy Policy contains more detail about how Picturehouse collects and uses your personal information. Please read our Privacy Policy carefully and make sure that you understand it before registering for a MyPicturehouse account.
  6. Please ensure you keep your contact information in your MyPicturehouse account up to date as we will use these details to get in touch with you about your account, your memberships and, if you have asked us to, to send you marketing communications.
  7. You must not share your ID or give access to your MyPicturehouse account through your ID to anyone else. We may suspend or cancel your account (and if you are a Picturehouse Member, your Membership) if you share your ID without our consent. 
  8. You are responsible for all use of your MyPicturehouse account whether by you or anyone else who is using your ID and you must prevent unauthorised use of your ID. We recommend that you change your user password regularly. 
  9. Access to the MyPicturehouse area of the Web Site and to MyPicturehouse accounts is restricted to authorised users only. Unauthorised individuals attempting to access the MyPicturehouse part of the Web Site or any MyPicturehouse account may be subject to prosecution.
  10. If you believe there has been any theft or unauthorised use of your ID or any payment information, you must notify us immediately at 0871 902 5747 (calls cost 13p a minute plus your telephone company's access charge or via [email protected] and immediately change your password by using the 'Forgot your password?' function on our website.

 

U25

  1. U25 benefits include discounts and offers made available to eligible U25 customers by Picturehouse and its partners from time to time ("U25 Offers and Discounts"). These offers may include discounts on standard price tickets for selected screenings on Mondays to Thursdays ("U25 screenings"), discounts on food and drink purchased in cinema and other perks (including offers from Picturehouse U25 partners).  Details of U25 Offers and Discounts will be published on the Picturehouse blog page from time to time, which can be viewed here and, if you have signed up to receive U25 or other relevant marketing emails from us, through our email communications. 
  2. If you are aged 16 to 25 and have a valid MyPicturehouse account you will be automatically eligible to receive and enjoy the U25 Offers and Discounts. Customers aged under 16 or 26 or over will not be eligible for any U25 Offers or Discounts. 
  3. When you register for your MyPicturehouse account, you will need to provide your date of birth. We will use your date of birth to validate your eligibility and entitlement to receive U25 Offers and Discounts (please see our Privacy Policy for more details about how we use your personal information (including your date of birth) and keep it safe).
  4. To obtain a U25 discount when booking your ticket for the selected U25 screening you must log in to your MyPicturehouse account and follow the on-screen ticket booking process. U25 ticket price discounts are only available online or through the Picturehouse app. You cannot book discounted tickets in person at the cinema.
  5. The level of U25 ticket price discount will be reflected in the prices published on the ticket price card on the Web Site for U25 tickets at the time of booking the ticket and will not be applied as a separate discount during the booking process. 
  6. To use the ticket at the cinema, you will need to bring some valid proof of age ID and show it to Picturehouse staff to enable them to verify your age when attending a screening. 
  7. You may book only one ticket for yourself for each U25 screening using the U25 ticket discount. You may not book these tickets for anyone else and only you may use the ticket (it must not be shared with or transferred or sold to anyone else). 
  8. Tickets for U25 screenings are subject to availability and will not give you any preferential rights of access for any screenings over other Picturehouse customers.
  9. Any U25 ticket price discount does not apply to the price of [3D glasses,] booking fees, SMS confirmation fees, or any other items or services which may be purchased online via the Web Site, unless otherwise stated.
  10. U25 Offers and Discounts and tickets purchased using the U25 ticket price discount may not be exchanged for cash or any other alternative and are not applicable for any screening other than the relevant U25 screenings. 
  11. In addition to these Terms, your booking and use of the ticket will be subject to the other Picturehouse Terms and Conditions and Terms of Admission, and if you book through the Picturehouse App any terms contained within the App, as applicable.  
  12. U25 Offers and Discounts may not be used in conjunction with any other offers or promotions offered by Picturehouse, or Picturehouse member discounts, unless otherwise stated. 
  13. All U25 Offers and Discounts are discretionary and may be withdrawn or changed by Picturehouse at any time without notice, so please check the Picturehouse blog and Website to keep up to date. 
  14. Picturehouse may also amend the terms of U25 (for example, eligibility criteria) and/or withdraw U25 in its entirety at its sole discretion at any time and without notice.

 

Changes to MyPicturehouse and these Terms 

  1. Picturehouse may withdraw or amend any offers, online facilities or functions available within or relating to any My Picturehouse accounts, and any related Terms, at any time without notice. Any such changes will be posted on the Website but you will not be specifically notified.
  2. Picturehouse may terminate, withdraw or suspend the My Picturehouse area of the Website including your My Picturehouse account at any time for any reason on reasonable notice in writing to you.
  3. Picturehouse may immediately suspend and/or terminate your MyPicturehouse account if:
    1. Picturehouse suspects any fraud in any matter connected to the registration for or use of a My Picturehouse account or any Picturehouse membership;
    2. you or anyone else misuses your MyPicturehouse account, any free or paid-for memberships or related benefits or offers, for example sharing them with others on social media or using them other than for reasonable personal use;
    3. you commit any other material breach of these Terms which cannot be corrected or if it can be corrected has not been corrected within a reasonable time; or
    4. you engage in any behaviour or activity that is disruptive to or damaging to any Picturehouse business or operation, process or practice, including breaching Picturehouse's Terms of Admission.
  4. If Picturehouse fails to comply with these Terms (My Picturehouse), we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time of registration for MyPicturehouse or purchase of your Picturehouse Membership, both Picturehouse and you knew it might happen.
  5. Picturehouse does not exclude or restrict its liability for fraud, for death or personal injury resulting from its negligence or that of its agents and nothing in this clause shall operate to exclude, restrict or limit this liability.
  6. Picturehouse will not be in breach of these Terms or otherwise be liable for any delay in performance of them to the extent that such breach or delay is due to circumstances beyond its reasonable control.
  7. English law governs these terms and all aspects of the relationship between Picturehouse and you for the registration for and use of a My Picturehouse account,  and any related offers and discounts (U25). Picturehouse will only write and communicate with you in English.

By booking Content with Picturehouse Entertainment you are entering into an Agreement with Picturehouse Entertainment and agree to be bound by the Booking Confirmation and these Terms and Conditions.

Please read these Terms and Conditions before booking with Picturehouse Entertainment. If you do not agree with these Terms and Conditions you may not book an Event with Picturehouse Entertainment.

Parties

  1. PICTUREHOUSE ENTERTAINMENT LIMITED of 7thFloor Vincent House, 30 Orange Street, London, WC2H 7HH (the "Distributor"); and
  2. The "Exhibitor" as defined on the Booking Confirmation.

Whereas

(A) The Distributor distributes content in the Territory and wishes to license the right to exhibit certain Events to the Exhibitor.
(B) The Exhibitor is the owner of certain cinema(s) or other establishments with cinema quality facilities and wishes to accept the licence described in the Booking Confirmation.
(C) The Distributor has agreed to make available to the Exhibitor certain Event(s) on the terms set out on these Terms and Conditions.

It is agreed as follows:

1 Definitions and Interpretation

  1. In these Terms and Conditions, the following terms shall have the following meanings: "Agreement": means these Terms and Conditions and the applicable Booking Confirmation; "Content Provider(s)": means the owner of the rights in the Event(s); "Distributor's Share": has the meaning given to it in the applicable Booking Confirmation; "Event(s)": means the performances as further detailed in the Booking Confirmation;"Booking Confirmation": means the Booking Confirmation for the applicable Event containing Event-specific terms agreed between the Distributor and the Exhibitor; "Event Schedule Term": has the meaning given to it in the applicable Booking Confirmation; "Format": means live by satellite or recorded by DCP or Blu-Ray, as applicable, as detailed in the Booking Confirmation; "Gross Box Office": means all sums actually and indefeasibly received by Exhibitor, for any right or license to exhibit the Event(s); "Net Receipts": means the Gross Box Office net only of VAT and any actual verifiable refunds; "Screening(s)": means the various screenings of the Event(s) to be held at the licensed Site(s); "Site(s)": means the venues where the Event(s) will take place, as detailed in the applicable Booking Confirmation; and "Territory": means the country where the Exhibitor is located.
  2. Clause and Schedule headings are for ease of reference only and shall not affect the construction of the Agreement.
  3. The terms 'include' and 'including' shall be construed without limiting the words preceding them.

2 Licence

  1. Subject to the full execution of these Terms and Conditions and in consideration of the agreement by the Exhibitor to pay to the Distributor the Distributor's Share, the Distributor shall grant a non-exclusive, revocable, non-transferable license to the Exhibitor for the duration of the applicable Event Schedule Term the right:
    1. to exhibit and screen the Event(s) in the Territory on the terms set out herein and the applicable Booking Confirmation; and
    2. to promote and market the Screenings, provided that no such licence shall take effect until the Exhibitor has received a Booking Confirmation from the Distributor.
  2. The parties agree and acknowledge that these Terms and Conditions do not:
    1. create an obligation to enter into any Booking Confirmation; or
    2. create an obligation for Distributor to license any Event(s) to the Exhibitor and the Exhibitor is not under the obligation to accept any licence of any Event(s).
  3. Exhibitor remains at liberty to screen content from another licensor or distributor.

3 Programming

  1. The licence granted in respect of each Event is for the non-exclusive right to exhibit the Event(s) for broadcast in High Definition in the Format, as applicable, at the Sites(s) as further set out in the applicable Booking Confirmation.
  2. Where the Format is live, as listed in the relevant Booking Confirmation:
    1. the Distributor shall supply the Event(s) to industry technical standards. In order to ensure the technical quality of the transmissions the live feed on the day of the Event(s) shall be broadcast no later than one hour prior to the actual commencement of the Event(s) to verify the signal and to permit troubleshooting and correction of any problems. The Distributor may provide additional satellite tests that will be notified to Exhibitor;
    2. the Exhibitor shall:
      1. participate in satellite signal path tests for the transmission signal for each Event(s), the timing of which shall be notified to the Exhibitor with sufficient notice for any changes or repairs to be organised ahead of the Event(s);
      2. adjust its technical receivers to correspond to the relevant tuning information distributed ahead of each Event(s);
      3. ensure that a qualified projectionist technician is available and on duty for the satellite tests and for each live broadcast and shall provide the contact details of such nominated projectionist to the Distributor in advance of such test and broadcast;
      4. promptly report any technical issues to the nominated technical support helpline notified to it. The Exhibitor shall periodically review its equipment to ensure and maintain the good local quality of Event(s) licensed under the Booking Confirmation; and
      5. use reasonable endeavours to clear the Site(s) of members of the public for Satellite Transmission tests by the Content Provider on the day of the Screening for two hours prior to the exhibition time, if this is not possible the Exhibitor shall check the signal via a TV monitor at the Site(s);
    3. the Exhibitor confirms that the satellite receiving equipment currently fitted in Exhibitor's Site(s) is suitable for the live downlinking of the Event(s) and that the minimum industry standards for HD projection and satellite equipment are met; and
    4. the Exhibitor agrees to comply with the minimum standards for HD projection and satellite equipment, that is HD projector resolution of 1920x1080 capable of displaying 50i 16x9 image format with no less than 7000 lumens brightness. Satellite equipment must be capable of outputting this format, including digital 5.1 and stereo sound. The Exhibitor will ensure that the satellite dish, receiver, projector and all related satellite equipment to be used has proper technical support and supervision in advance of the Event(s) as well as on the day of the Event(s). In the event that the Distributor (acting reasonably) has any doubts about the technical capability of the satellite equipment or its operation the Distributor shall not be obliged to supply the Event(s) to the Exhibitor. Any technical specification that does not adhere to the above standards will require the Distributor's prior written approval.
  3. Where the Format is recorded, as listed in the Booking Confirmation:
    1. the Distributor shall provide each individual Event(s) on a Digital Cinema Package ("DCP") or Blu-Ray, whichever is applicable, to the Exhibitor in advance of the screening date. The Exhibitor shall test the DCP or Blu-Ray on its arrival and shall notify the Distributor immediately if there are any problems with regards to the DCP or Blu-Ray;
    2. the Exhibitor confirms that the equipment currently fitted in Exhibitor's cinemas meets that the minimum industry standards for HD projection; and
    3. where the Exhibitor is screening the Event(s) via DCP the Exhibitor confirms that they have the capacity to do the same and they will ingest the content onto their servers upon receipt.
  4. The Distributor shall provide a pre-paid return shipment package with each DCP. The Exhibitor shall return each DCP within 5 days of its last screening date of each individual Event. The costs of delivery pursuant to Clause 3.3.1 and of return shipment to the Distributor shall be charged back to the Exhibitor.

4 Payment Terms

  1. The Exhibitor shall be entitled to issue up [3 pairs] of complimentary tickets per Screening. Any concessionary tickets issues will be in good faith and on legitimate grounds. Any illegitimate concessionary tickets issued and/or any complimentary tickets issued over the threshold set out in this Clause 4.1 shall be calculated as full price tickets for the purposes of calculating the Gross Box Office.
  2. The Exhibitor shall pay to the Distributor the Distributor's Share and the Satellite Fee, if applicable, as set out in the relevant Booking Confirmation.
  3. Unless otherwise agreed in the Booking Confirmation, the Exhibitor shall pay the Distributor's Share to the Distributor within ten (10) days following the end of the Event Schedule Term.

5 Reporting Obligations

  1. The Exhibitor will provide the Distributor with weekly ticket sales reports detailing the number of tickets sold, the ticket prices and the Net Receipts in the run up to the Screening(s) commencing from the on sale date for any and all applicable Event(s).
  2. Reports issued by the Exhibitor hereunder will include all information requested by the Distributor and, in any event the following: i) the Gross Box Office ii) the Net Receipts iii) the number of admissions iv) the number of concessionary admissions v) the number of complimentary tickets issued vi) the number of refunds issued vii) the ticket prices used viii) the number of admissions possible at full capacity.
  3. Without prejudice to the Distributor's other rights and remedies, the Distributor may charge the Exhibitor daily interest on late payment of the amounts due, at a rate of 4% (four per cent) per annum above the then base lending rate at Barclays Bank plc (at the date the payment was due), from the due date until the date of the actual payment (both before and after any judgement). If the Exhibitor fails to pay or procure payment of any sums due to the Distributor and/or its Content Provider(s) in accordance with these Terms and Conditions and/or the relevant Booking Confirmation then the Exhibitor will pay such sums on demand and will also reimburse the Distributor and/or its Content Provider(s) for any and all expenses (including without limitation legal fees) incurred by the Distributor and/or its Content Provider(s) in recovering such amount(s).
  4. The Distributor and/or its authorised representative shall have the right upon written request to full access to, and audit of, the books and records of the Exhibitor insofar as they relate to the applicable Event(s) and to payments due to the Distributor and/or its Content Provider(s) as appropriate. The costs of any such audit shall be the Distributor's unless errors exceeding the lesser of 5% (five per cent) and £100 (one hundred pounds sterling) of the sums due to the Distributor shall be found in which case the costs shall be paid or reimbursed by the Exhibitor. In the event that such examination reveals that monies are due to the Distributor and/or its Content Provider(s) such monies shall be paid over to the Distributor and/or its Content Provider(s) together with interest calculated in accordance with Clause 5.3 above within 30 (thirty) days of the results of such examination being expressed to the Exhibitor.

6 Marketing and Promotional Commitments

The Exhibitor and the Distributor shall use their reasonable endeavours to promote the Event(s) via the following activities:

Exhibitor Responsibilities:

  1. the Exhibitor undertakes that it shall utilise all communication channels to adequately and professionally promote the Event(s), including within the Sites(s), online and via email. The Exhibitor must provide a link via the appropriate section of its website to the website of the Content Provider(s);
  2. all Exhibitor generated marketing materials (or altered provided materials) shall be submitted for approval by the Distributor and/or its Content Provider(s) in accordance with Clause 7 below. In no event may the Exhibitor alter any logos and/or credits on marketing materials provided by the Distributor and/or its Content Provider(s); and
  3. the Exhibitor shall adhere to any and all marketing obligations specified in these Terms and Conditions and any applicable Booking Confirmation; and

Distributor's Responsibilities:

the Distributor will, in liaison with the Content Provider(s) where relevant, use its reasonable endeavours to provide the Exhibitor with access to any marketing materials which exist for the applicable Event, or example:

  1. trailer;
  2. digital delivery of posters; and/or
  3. other marketing materials as discussed in good faith.

7 Approvals

  1. All marketing materials created by the Exhibitor (including without limitation printed advertisements, brochure advertising, posters, flyers, postcards and online and email advertising), all marketing materials supplied to the Exhibitor which are subsequently altered by the Exhibitor (excepting customary resizing of images) and all press releases created by the or on behalf of the Exhibitor will be subject to prior approval of the Distributor. Such approval may be exercised in the Distributor's absolute discretion. For the avoidance of doubt, all materials supplied to the Exhibitor by the Distributor and used unaltered do not require further approval of the Distributor.
  2. Where any approval or consent is required, the party seeking such approval or consent shall afford the other a reasonable opportunity to consider the matter or materials in respect of which its approval or consent is sought and any such approval or consent shall not be unreasonably withheld or denied and if given it shall be communicated in a timely manner. In no event may approval be deemed due to non-response to a request. All approvals or consents given under the Agreement are to be signified in writing.

8 Representations and Warranties

  1. The parties represent that they have full power and authority to enter into and perform their obligations under these Terms and Conditions and any applicable Booking Confirmation.
  2. The Distributor warrants that it has been, or will be, granted a licence in respect of the Event(s) covered by the applicable Booking Confirmation to enable it to grant the rights granted to the Exhibitor hereunder.
  3. The Distributor warrants that, to the best of its knowledge, the grant of a licence to the Exhibitor of the rights in the Event(s) will not infringe the intellectual property rights, including but not limited to any copyrights in the audio-visual recordings, or the moral rights of any third party. Notwithstanding the foregoing the Exhibitor shall be responsible for the payment of any royalties that may become due to rights management societies in the Territory as a result of the Exhibitor's exhibition of the Event(s).
  4. The Exhibitor warrants that it shall keep the Sites(s) available, and in a good state of repair and cleanliness, for the Screenings and shall use all reasonable care and skill so that the Site(s) and the Screenings shall be of the highest quality.
  5. The Exhibitor warrants that it shall only exhibit the Events in accordance with the terms of this Agreement.
  6. The Exhibitor undertakes to not knowingly put the Distributor in breach of any agreement between the Distributor and the Content Provider.
  7. The Exhibitor warrants that it shall not act in any manner which may (i) be harmful to the goodwill of the Distributor and/or its Content Provider(s), or (ii) bring the Distributor and/or its Content Provider(s) into disrepute, or (iii) be defamatory, obscene or otherwise actionable, or (iv) detrimentally affect or prejudice or infringe the business or intellectual property rights of the Distributor and/or its Content Provider(s).
  8. The Exhibitor shall maintain and observe commercially reasonable measures (both technological and procedural) to monitor and prevent misappropriation of the Distributor's and/or its Content Provider's property. Where the Exhibitor receives a digital file or tape of the Event(s) for a recorded Screening(s) the Exhibitor shall carry out such commercially reasonable continual security control checks as are required to ensure the security of the digital files. The Exhibitor shall immediately notify the Distributor of any materially significant vulnerability in its internal security system of which it becomes aware. The Exhibitor shall promptly notify the Distributor of any infringement of the Exhibitor's, the Distributor's and/or the Content Provider(s) intellectual property or trademarks which may come to the Exhibitor's notice, including any unauthorised third party reception or recording of any performance.
  9. The Exhibitor shall screen the Event(s) in their entirety without any cuts or alterations. The Exhibitor will not alter or impair any copyright notice or acknowledgement of the Distributor's and/or the Content Provider(s) other intellectual property rights or any credit(s) that may appear in the Event(s) and/or the associated marketing materials, including all copyright, trademark and similar notices that need to be used and displayed, including any production and sponsorship credits. Moreover the Exhibitor shall not exhibit, during the Screening of the Event(s), any other image than those transmitted by the Distributor and/or its Content Provider(s), unless having first obtained the written consent of the Distributor.
  10. The Exhibitor acknowledges that the Distributor and/or its Content Provider(s) may seek sponsorship for the Event(s) and in such instances the content and/or marketing materials provided may include details of such sponsorship. In no event may the Exhibitor remove any sponsorship messaging without the Distributor's prior approval. The Exhibitor shall not be entitled to any remuneration as a result of such sponsorship.

9 Liabilities and Indemnities

  1. The Exhibitor will indemnify, defend and hold harmless the Distributor and each of its directors, trustees, officers, shareholders, employees, agents, representatives, affiliates, successors, and permitted assigns, as applicable, from and against all claims, damages, costs and fees (including reasonable external legal fees and court costs) arising out of or in connection with the Exhibitor's breach of any covenant, undertaking, representation or warranty given by the Exhibitor herein.
  2. Nothing in this Agreement shall exclude a party's liability for fraud or theft by it or its employees or death or personal injury caused by its negligence or that of its employees, agents or subcontractors as applicable.
  3. The Distributor shall have no liability whatsoever in respect of any claim for loss or damage (and related costs and expenses) and other liability whatsoever from any person attending the Event(s) which arises in respect of any breach in the security or safety of the Site(s) or of the negligence on the part of the employees at the Site(s), and the Exhibitor fully and expressly indemnifies the Distributor in respect of any such claim.
  4. All indemnities provided pursuant to this Agreement will be subject to the Distributor seeking to rely on such indemnity: (i) promptly notifying the Exhibitor in writing of such claim; (ii) giving the Exhibitor reasonable information, assistance and co-operation required to defend such suit, claim, or proceeding; and (iii) allowing the Exhibitor sole control of the defence and all related settlement negotiations, provided that it shall conduct such defence and settlement negotiations without taking or failing to take any action which would be prejudicial to the Distributor without prior written consent.
  5. Neither party shall, in any manner whatsoever, be liable or otherwise responsible for any delay or default in, or failure of, performance resulting from or arising out of or in connection with any Event of Force Majeure and any such delay, default in, or failure of, performance shall not constitute a breach by either party hereunder. As used herein, "Event of Force Majeure" in respect of a party shall mean any reasonably unforeseeable act, cause, contingency or circumstance beyond the reasonable control of such party, including without limitation, to the extent beyond the reasonable control of such party, the cancellation or postponement of an Event(s) as a result of transmission, broadcast, recording or technical problems of any kind, the cancellations by the artist(s), the artistic value of the Event(s), replacement in the casting and/or changes in the Event(s) timing, any governmental action, order or restriction (whether foreign, federal or state), war (whether or not declared), public strike, riot, labour dispute, act of God, public disaster or laboratory dispute.
  6. The total liability of the Distributor to the Exhibitor whether arising from tort (including negligence), breach of contract or otherwise under or in connection with this Agreement shall be limited to the Distributor's Share.

10 Termination and Action on Termination

  1. Either party may terminate these Terms and Conditions without cause by giving 3 (three) months written notice to the other. For the avoidance of doubt, in such circumstances termination of these Terms and Conditions shall not affect the parties' obligations and liabilities to each other in respect of any Event in respect of which the applicable Event Schedule Term has not expired.
  2. These Terms and Conditions and any Booking Confirmation shall automatically and immediately terminate immediately by written notice to the other if the other is the subject of a petition for a bankruptcy order or becomes insolvent or enters into any arrangement, scheme or composition with its creditors or if any of the other parties assets are subject of any form of seizure, or the other party goes into liquidation either voluntarily (otherwise than for reconstruction or amalgamation) or compulsorily, or a receiver or administrator is appointed over any or all of the other party's assets.
  3. Either party may terminate any applicable Booking Confirmation by written notice to the other if the other commits any material breach of any of the provisions of the Agreement in relation to an Event and, in the case of a breach capable of remedy, fails to remedy the same within 7 (seven) days of receipt of a written notice giving full particulars of the breach and requiring it to be remedied. In the event of repeated breaches of these Terms and Conditions and/or any applicable Booking Confirmation by the other, either party may terminate both these Terms and Conditions and any applicable Booking Confirmation by written notice to the other.
  4. In the event that any Content Provider(s) shall terminate a licence agreement with the Distributor for any reason whatsoever with the result that the Distributor may no longer grant the rights to the Exhibitor in respect of any applicable Event(s), the Distributor shall inform Exhibitor and the applicable Booking Confirmation will terminate immediately and the Distributor shall have no further liability to the Exhibitor in respect of that Event.
  5. In addition to the above rights, the Distributor shall have the right to terminate these Terms and Conditions and/or any applicable Booking Confirmation in the event that the Exhibitor is subject to numerous technical difficulties during broadcasts of Event(s) which threaten the reputation of the host venue of the Event(s), the Distributor and/or the Content Provider(s).
  6. On termination, or expiry, of each Booking Confirmation:
    1.  the Exhibitor will immediately return any digital files or tapes of the Event(s), delete any local recordings of the Event(s) and return or destroy any recordings of the Event(s), marketing and/or promotional materials created;
    2. all monies due to the Distributor at the date of termination shall be immediately due and payable by the Exhibitor;
    3. clauses which are expressly intended to survive the expiry or earlier termination of these Terms and Conditions or any added Booking Confirmation shall survive in full force and effect; and
    4. each party will remain liable to the other for any sums which are due but have not been paid and any other breaches of these Terms and Conditions or any added Booking Confirmation.

 

11 General Provisions

    1. Any notice or other document to be served under the Agreement shall be in writing and may be delivered or sent to the party to be served at its address first above written or at such other address designated from time to time by notice by the party concerned. Any notice or other document shall be sufficiently served if delivered by hand or sent by prepaid first class recorded delivery post addressed to the person designated for that purpose. Notices shall be deemed to have been served three (3) working days after the date when posted or, if personally delivered, when delivered.
    2. The Exhibitor shall comply with all filing and payment obligations with rights management societies in the Territory and shall promptly pay any and all taxes and duties due as a result of exhibiting the Event(s).
    3. The Agreement may not be modified except in writing signed by the parties hereto.
    4. The Distributor shall be freely entitled to assign or transfer the benefit of the Agreement to any third party. The Exhibitor shall not be entitled to assign or transfer the benefit of the Agreement without the Distributor's prior written consent.
    5. Any delay by a party in exercising or its non-exercise of any right granted to that party under the Agreement shall not be deemed a waiver of that right.
    6. Nothing in the Agreement will be deemed to constitute a partnership between the parties nor constitute either party as the agent of the other party for any purpose.
    7. Confidential Information.
      1. The parties agree to treat with the strictest confidentiality any Confidential Information (as defined in Clause 11.7.2 below), in particular trade secrets of the other party, which may come into their possession in connection with this Agreement, and to neither pass it on to third parties nor exploit it in any other way. This applies to any unauthorized third parties, that is, also unauthorized employees of the parties, insofar as the sharing of information is not part of the proper fulfilment of the contractual obligations. The parties agree that, when in doubt, the parties shall seek consent from the other before sharing any information. In addition, any applicable statutory data protection regulations also apply.
      2. "Confidential information" shall mean any information that one party discloses to the other in connection with the Agreement, whether in written, verbal, visual, or electronic form, and which is identified as "Confidential" (or whose confidential nature is self-evident from the circumstances). In particular, any technical and marketing-relevant information about movie theatres, even if these are not marked "Confidential", shall be deemed to be confidential.
      3. Information is not considered as Confidential Information for purposes of this Agreement if:

       

      1. it has been legally acquired from third parties which are not bound by an obligation to maintain confidentiality and which did not receive this information through a violation of the data protection regulations; and/or
      2. one of the parties has discovered such information independently and without recourse to information provided by the other party; and/or
      3. the information involved has become known publicly through no fault of or without assistance from one of the parties.
    8. Each party agrees at the cost of the requesting party to execute, acknowledge and deliver such further instruments and to do all such further acts and things as may be necessary or appropriate to give full effect to the Agreement.
    9. Excluding the Content Owner's ability to bring claims against the Exhibitor for improper use of its content, a person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of this Agreement but this does not affect any right or remedy of a third party which exists or is available apart from that Act.
    10. Except to the extent of any misrepresentation or breach of warranty which constitutes fraud, the Agreement (constituting these Terms and Conditions and the applicable Booking Confirmation) constitutes the entire agreement between the parties relating to the transactions contemplated by these Terms and Conditions and the applicable Booking Confirmation and supersedes any and all prior understandings or agreements whether oral or written.
    11. The applicable Booking Confirmation shall form part of the Agreement upon full execution thereof.
    12. These Terms and Conditions shall be read in conjunction with the applicable Booking Confirmation. In the event of any conflict between these Terms and Conditions and the applicable Booking Confirmation, the terms of the applicable Booking Confirmation shall prevail.
    13. These Terms and Conditions and any and all Booking Confirmations may be executed in counterparts, each of which shall constitute an original but which, when taken together, shall constitute one instrument. A counterpart signature page of these Terms and Conditions and any Booking Confirmation executed by a party and sent by facsimile or transmitted electronically as a tagged image format file (TIFF) or in portable document format (PDF) shall be treated as an original, fully binding and with full legal force and effect, and the parties waive any rights they may have to object to such treatment.
    14. The Agreement (and any non-contractual obligations arising in connection with it) shall be construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts thereof.
  1. In addition to the other sections of the Web Site Terms of Use, the following terms apply if the User purchases merchandise and/or food and beverages ("retail items") through the Website or the App. The terms in this clause do not apply to purchases of tickets, Gifts, Gift Cards, Gift Boxes, e-Gift Cards or the Membership, to which other terms apply.
  2. By requesting retail items through the Website or the App, the User is placing an order for a voucher ("concessions voucher") to exchange for specific retail items in the User's chosen Picturehouse cinema on the Terms that the order is only deemed accepted by and binding on Picturehouse once it has processed valid payment and sent the User email confirmation of the User's order. Picturehouse reserves the right not to accept orders.
  3. The email confirmation of an order will attach the concessions voucher which will set out the details of the retail items selected together with a unique 'order reference number'.Other than the rights to cancel during the cancellation period as detailed below, once this confirmation has been sent, the purchase price is non-refundable and no changes may be made to the order. Picturehouse is not responsible in the event that the User selects the wrong retail items when placing an order via the Website.
  4. By purchasing a concessions voucher the User is expressly requesting the ability to use the concessions voucher as soon as they receive it. The User can pick up their retail items at the Click and Collect point (where available) or the Concession Counter of their selected Picturehouse cinema following receipt of confirmation of the order.
  5. The User will need to present either (i) the printed concessions voucher or (ii) the order reference, or (iii) the payment card used to place the order for the concessions voucher at the Concession Counter of the chosen Picturehouse cinema, in order to collect the relevant retail items. Where Picturehouse has advised the User that e-ticketing is available for a particular booking, the User may present their e-ticket (included in their email confirmation of an order on their mobile phone or on a print out to be checked by a Picturehouse staff member at the Concession Counter to collect the relevant retail items or request that their concessions voucher is printed.
  6. When the User redeems all or part of the concessions voucher the retail items collected will be deducted from the balance on the concessions voucher. The User must collect their retail items within 3 months of the date of purchase of the concessions voucher. Any retail items included on the concessions voucher which are not collected within that 3 month period will be cancelled and no refund will be given.
  7. Picturehouse will endeavour to supply all retail items specified on the concessions voucher on presentation of the relevant concessions voucher, but reserves the right to substitute the chosen retail items with alternative products of an equivalent or greater value where not available.
  8. To make any payment by credit/debit, the User must provide the cardholder's name and email address, the card number, the card security code, the card expiry date and (where applicable) the card start date and/or issue number. Transactions will appear on the cardholder's bank or card statement as a payment to Picturehouse for purchases in UK.
  9. Retail items are sold at the prices for the relevant items as stated on the Website or the App at the time of purchase of the concessions voucher. Users should be aware that prices may change between the date of purchase and the date of collection of the retail items. Not all products, prices, offers and discounts for retail items available in-cinema will be available through the Website or the App and not all products, prices, offers and discounts available on the Website or the App will be available in-cinema. Except for our right to make substitutions (as set out above), concessions vouchers may only be redeemed for the retail items specified in the concessions voucher. No difference in price paid at the time of purchase may be claimed where prices, offers and discounts differ in cinema to those on the Website, at the time of purchase of the concessions voucher or collection of retail items or otherwise.
  10. Concessions vouchers may not be exchanged for cash. Other taxes or costs may exist in relation to the concessions voucher that are not imposed by Picturehouse.
  11. The concessions voucher does not entitle the User to preferential treatment over other Picturehouse customers for the collection of retail items.
  12. Where Picturehouse Members are entitled to claim discounts on retail items, they must do so in-cinema as discounts may not be claimed for retail items or concessions vouchers ordered through the Website or App.

    Cancellation Rights
  13. The User may cancel their order for retail items and claim a refund by cancelling the concessions voucher at any time up to fifteen (15) calendar days from (and including) the day on which the User receives the email confirming acceptance of order as above (the "Cancellation Period"). If the concessions voucher has been used before the cancellation has been processed the amount of the refund will be reduced to reflect such use.
  14. If the User wishes to cancel their order for the concessions voucher, they should write to the Picturehouse Cinemas Limited, Customer Services Department at 8th Floor Vantage London, Great West Road, Brentford, TW8 9AG or email [email protected] and by phone on 0207 326 2649, stating the booking reference detailed on the concessions voucher. Once the Cancellation Period has expired the User will not be able to cancel their purchase or claim a refund of the value of the concessions voucher.

    Liability
  15. Except as expressly provided in these Terms, all warranties, conditions or other terms in favour of the User or any other person who uses the concessions voucher implied by Statute or common law are excluded to the fullest extent permitted by law. Nothing in these terms is intended nor shall it be construed to limit our liability for fraud or death or for personal injury caused by Picturehouse's negligence.
  16. Picturehouse shall not be liable to the User or any other person who uses the concessions voucher by reason of any failure or delay in performing any of its obligations in relation to issue or redemption of the concessions voucher or the User's request for retail items through the Website or App under these terms if the failure or delay was due to any cause beyond Picturehouse's reasonable control.
  17. Picturehouse's liability to the User or any other person who uses the concessions voucher shall not exceed the amount paid by the User for the concessions voucher. No other out of court complaint or redress system or compensation scheme exists in relation to the concessions voucher or the purchase of retail items.

    Governing Law and Jurisdiction 
  18. English law governs these terms and all aspects of the relationship between Picturehouse and the User for the purchase of the concessions voucher, unless the address the User gives to Picturehouse when placing their order for a concessions voucher is in Scotland, when Scottish law applies or in Ireland, when Irish law applies. Picturehouse will only write and communicate with the User in English.
  19. If the User's residential address is in the UK or The Channel Islands, the agreement for the purchase of the concessions voucher will be with Picturehouse Cinemas Limited (company registered number 2310403), registered office 8th Floor Vantage London, Great West Road, Brentford, TW8 9AG.

Discover Retail Trial Offer

 

  1.  The Discover retail trial offer will be available at Picturehouse Finsbury Park, Greenwich, Arts Cambridge and Harbour Lights Southampton (not available at any other Picturehouse cinemas). Picturehouse Members who buy a £3 Discover ticket will also receive a £3 discount to use on concessions at the cinema on the date of their Discover screening (Retail Offer).
  2. The Retail Offer will be available at the participating cinemas every Tuesday until 17 June 2025.
  3. To claim the £3 discount, Members must show their Membership card together with their booking confirmation / ticket when purchasing their food & drink at the concessions counter.
  4. Members will also receive their usual % Member discount on food & drink, and the £3 discount will be deducted from the final amount after the Member discount has been applied.
  5. Members who share a Member Plus membership will be able to claim one £3 discount each. Each Member Plus Member must claim their £3 discount separately, as the £3 discounts cannot be combined for use in the same transaction.
  6. The Retail Offer will only be available on Tuesdays during the offer period.
  7. There is no cash alternative. A minimum spend of £3 on food and drink is required to redeem this offer.
  8. The £3 discount is only available for use at the cinema on the day of the Discover screening and, if unused, may not be rolled over for use at other times.
  9. Picturehouse may change or withdraw the Retail Offer at any time without prior notice.

 

Film Club Membership Offer (2024)

 

  1. Film Club Offer strictly limited to holders of a valid, paid Picturehouse Membership.
  2. Holders of free Silver Screen and MyPicturehouse accounts are not eligible for the Offer. 
  3. Film Club will run until 31 December 2024, subject to point 12 below.  
  4. Standard and Student Members are entitled to 1 x £1 ticket per Membership for each Film Club branded screening at Picturehouse. Member Plus Members are entitled to 2 x £1 tickets per Membership for each Film Club branded screening at Picturehouse.
  5. Usually Member Plus Members are entitled to bring up to 3 guests with them at Members prices, however the offer of £1 tickets does not extend to these guests. The guest ticket price is required to be paid for any additional guests.
  6. All tickets (£1 or otherwise) are subject to availability, no cash or other alternatives will be available. 
  7. Member Free Tickets cannot be used for Film Club screenings. Offer is in addition to and has no impact upon the Member Free Tickets issued with a paid Picturehouse Membership.
  8. Film Club branded screenings may not show at all Picturehouse Cinema sites. Please check the website for details. 
  9. Members may book their £1 tickets for Film Club branded screenings online when logged in to their My Picturehouse account, or at the box office by presenting their Membership card.
  10. A fair use policy applies to use of the £1 tickets. If you have booked to see a Film Club branded film but are then unable to attend the screening, you should contact our Customer Care team on 0207 733 2229 or [email protected] with your order reference number as soon as possible so the ticket can be made available to another Member.
  11. £1 ticket holders should be in their seats by the end of the trailers. If you are not seated at this time we reserve the right to allow another customer into the screening in your place.
  12. Picturehouse Cinemas reserve the right to change or withdraw the Film Club Offer at any time without notice.
  13. Picturehouse Cinemas Ltd is the owner and operator of the Picturehouse Membership scheme and is the promoter of the Offer.  

 

2. Black Friday Membership Sale 2024

  1. Black Friday Discount of 30% off the price of first 12 months of Picturehouse Membership ("offer") applies to qualifying purchases of Membership made from 29 Nov 2024 to 2 Dec 2024 (dates inclusive)("offer period")
  2. Offer available only on new recurring annual subscription Memberships purchased online at www.picturehouses.com and Memberships purchased in cinema during the offer period.
  3. Offer not applicable to:
        - online purchases of 12 month One-Off Payment Memberships
        - Gift Memberships
  4.  Offer applies to the first year of Membership fees only. Subsequent payments of Membership fees (for recurring annual subscriptions and for 12 month one-off Memberships) will be charged at the full price applicable at the time of renewal.

3. Our Picturehouse Video Campaign

 1. Acceptance of these Terms 

By applying to be part of the "OUR PICTUREHOUSE" Video Campaign ('Campaign'), you will be deemed to have accepted, and to have agreed to be bound by, these terms and conditions. All instructions, rules and conditions on any advertising or promotional materials relating to the application process and the Campaign form part of these terms and conditions, provided that in the event of any conflict or inconsistency, these terms and conditions shall prevail. 

 

2. Participants

To apply for a chance to appear in the Campaign, you must be a UK resident aged 18 years or over with an active Picturehouse Membership (if so, please specify and confirm your local Picturehouse) OR you can be a regular customer (if so, please specify your local Picturehouse when contacting us). You must be willing to have your voice used in the Campaign and if successful, be filmed, for the Campaign. The Campaign will be screened across all 25 Picturehouse Cinemas and also posted online on the Picturehouse website and social media channels. You must be available for filming on one of our filming dates in either November or December 2024 (a specific date will be arranged directly with the successful participant closer to the time of filming). The Campaign is not open to employees of Picturehouse Cinemas, their immediate families, or anyone else connected with the Campaign. 

 

3. How to Apply

To apply to be part of the Campaign, you will need to submit your cinema story ("Story") to us by either calling us and leaving a voice message on: 020 3835 5250* or by emailing us at [email protected] by 20 November 2024. Please also include in your voice message or your email the following information: 

  • Your name

  • Your local Picturehouse Cinema, and/or where are you currently based 

  • Your phone number and (if submitting your application by phone) your email address. 

You must be the person who leaves the phone message or sends the email. Your application will be rejected if your voice message or email : i) contains defamatory, malicious, indecent, immoral or other inappropriate content including sexist or racist language, ii) includes the names, likenesses or similar of any individual without their express permission; iii) condones or encourages violent or anti-social behaviour; iv) causes offence on the grounds of religion, gender, sexual orientation, nudity, disability or age; or have negative attitudes about the promoter or any of its related partners; or v) you do not provide all of the information detailed at points 1 to 3 of this How to Apply section.

Picturehouse reserves the right, at its sole discretion, to eliminate or disqualify entries that it regards as being in breach of these conditions or the spirit of the Campaign.

Picturehouse accepts no liability for any technical issues of any kind that may prevent anyone from applying.

*Please note, calls will be charged at a standard BT landline rate 20p per minute. Charges from other networks and mobile providers may vary. Please always ask the bill payer's permission before phoning.

 

4. Closing Date

The deadline for entries is Wednesday 20th November 2024 at 09:00 GMT (the 'Closing Date'). 

 

5. The Selection Process

Picturehouse Cinemas Limited ("Picturehouse") together with its partner, LonelyLeap Ltd (production company), will review all valid applications and Picturehouse will shortlist a number of applicants based on their Stories. If your Story is shortlisted, Picturehouse will contact you directly (or LonelyLeap may contact you on our behalf) by telephone or email to explore your Story further with you.  If, after that discussion, we decide we would like to include you and/or your Story in the Campaign, we (or LonelyLeap) will confirm your invitation to attend a filming day ("Filming Day") and provide further details, including the proposed date, timings and the location of filming. Please note that Picturehouse is unable to respond to all entries – if you aren't contacted by a member of the team by 7th] December 2024 or if you don't receive an invitation to attend a filming day, please deduce that your application has not been successful on this occasion.  

If Picturehouse is unable to contact you, or if you are not available or unable to participate in the Filming Day, we reserve the right to select an alternative applicant, selected in accordance with these terms and conditions. Picturehouse's decision regarding successful applications and choice of Story and applicant will be final and no correspondence will be entered into. 

You may be required to take part in publicity, and by submitting your application, taking part in a Filming Day and/or Campaign you hereby agree to take part in any such publicity. Your, name, contact details and Story will be shared with LonelyLeap so that they contact you on our behalf and to assist us with the creation and fulfilment of the Campaign. 

 

6. Filming and the Filming Day

If your application is successful, you will receive an invitation to a Filming Day by email.  You will need to arrange and pay for travel to the UK filming location. Travel expenses will not be reimbursed. All other expenses, including but not limited to accommodation and travel insurance, are your responsibility. 

Picturehouse will provide you with food and non-alcoholic beverages during the hours of filming. No food or non-alcoholic beverages will be provided outside of filming hours. 

If you wish to bring an accompanying guest with you to the Filming Day, please let us know in advance. 

Prior to the Filming Day, you will be required to sign a Co-promotion Agreement, which will include:

  • a  Release Form to grant Picturehouse and LonelyLeap, and their respective group companies, affiliates and agents the right to use your Story and any photographs, audio recordings and/or video footage featuring your image, likeness, voice, statements and performance ('Contribution') with or without your  name and any biographical information you provide or that is captured during the Filming Day, for advertising, marketing, promotional, public relations and any other lawful purposes, in any and all media worldwide, for a period unlimited in time and without further consent or payment. You agree that your Contribution may be combined with text, music, sound, graphics and other content, and cut, altered, modified, cropped, edited or dubbed into another language without notice.

  • a Non-Disclosure Agreement (NDA), in which you will agree not to speak about or otherwise disclose anything that is discussed, filmed, or mentioned  in relation to the Campaign and/or on the Filming Day.

  • Data Protection provisions, allowing Picturehouse and LonelyLeap to use and process your personal data contained in your application and any, photographs, audio recordings and video footage of you, in accordance with section 8 below.

Picturehouse is not obliged to use your Story or any photographs, audio recordings or filmed footage of you provided in connection with your application or captured during the Filming Day, and attending the Filming Day does not guarantee placement in the final Campaign.

It is your responsibility to highlight any part of the filming that you feel will be uncomfortable or difficult for you to undertake, this may include notifying Picturehouse of any condition which may impact your ability to participate in the filming. Please let us know in advance if you have any accessibility requirements.  

 

7. Your agreement to our use of your Story 

Picturehouse may choose to use your Story , whether shortlisted or not (with or without your' name and any biographical information), for advertising, marketing, promotional, public relations and any other lawful purposes, in any and all media worldwide, for a period unlimited in time and without further consent or payment. You (i) agree that your Story, whether shortlisted or not, may be combined with text, music, sound, graphics and other content, and cut, altered, modified, cropped, edited or dubbed into another language without notice and (ii) hereby irrevocably and unconditionally waive, in favour of Picturehouse, LonelyLeap and their respective group companies, affiliates and agents, all moral rights, performers' rights and similar rights arising under the laws of any jurisdiction in respect of your Story (whether shortlisted or not). 

 

8. Data Protection

All personal data which you provide to us in connection with your application and otherwise collected by us in connection with the Campaign will be treated in line with Picturehouse Cinemas' Privacy Policy: https://www.picturehouses.com/privacy&dataprotection, and will only be used and shared for the purposes of the Selection Process, Filming Day, Campaign and Campaign marketing. 

In particular: 

  • Picturehouse is the data controller responsible for your personal information obtained in connection with your application and participation in the Filming Day and Campaign, unless we advise otherwise. 

  • Picturehouse will process, and permit the processing of, your personal data (including any personal data contained in any audio recordings, photographs and video footage) submitted by you or collected by us or on our behalf for the purposes the Campaign, your application to participate in the Campaign and Campaign marketing and for related record-keeping purposes. Please note that such materials, if published, may be visible to anyone who visits our websites, uses our apps, engages with our social media or receives our communications (including our e-newsletters), whether within or outside the United Kingdom. 

  • It is in Picturehouse's legitimate interest to use and process your personal information in connection with your application to be part of and to participate in the Campaign. 

  • You have certain rights in relation to your personal data, including: to obtain copies of it; to have it corrected or deleted; to limit the way in which it is used; to object to its use; to transfer it; not to be subject to decisions based on automated processing (including profiling); and to complain to the regulator, the UK Information Commissioner's Office. You can find details about how to do this on their website at https://ico.org.uk/concerns/ or by calling their helpline on 0303 123 1113. Please note that many of these rights are not absolute and the extent to which they apply may vary depending on the circumstances and any exemptions that may apply

9.  Promoter and Promoter's Rights 

The promoter of the application process and Campaign is Picturehouse Cinemas Limited. Registered office: 8th Floor, Vantage London, Great West Road, Brentford, TW8 9AG). Picturehouse Cinemas reserves the right to (i) amend these terms and conditions at any time and without notice, and (ii) terminate or suspend the entrant process and Campaign at any time due to circumstances beyond its control.

 

10. Exclusion 

Anything not specified in these terms and conditions as being included in the application process and / or Campaign is excluded.

 

11. Limitation of Liability 

You agree to the fullest extent allowed by applicable law to release and forever discharge Picturehouse Cinemas Limited and LonelyLeap Limited and their respective parent corporations, subsidiaries, assigns and employees, and any entity or person connected with the Campaign and the application process to participate in the Campaign from and against any and all claims, demands, losses and liabilities of any nature whatsoever which may now or hereafter arise, including but not limited to any loss of enjoyment, costs, delays or other harm or loss of any nature whatsoever caused by, contributed to, or arising out of or in connection with the application process, Selection Process, Filming and Filming Day and/or the Campaign.

 

12. Jurisdiction

4. It Was Just An Accident - Gift with Purchase 

1. To collect your postcard set, simply show your valid ticket to see It Was Just An Accident at the box office at participating cinemas.
2. There are a limited number of postcard sets available at each cinema, to be collected on a first come first served basis.
3. The offer is only available at participating cinemas showing It Was Just An Accident from Friday 05 December 2025.
4. Offer is valid for one postcard set per ticket.
5. There is no cash alternative.
6. Offer may be withdrawn at any time.

 

5. Kill Bill: The Whole Bloody Affair - Gift with Purchase 

1. To collect your print, simply show your valid ticket to see Kill Bill: The Whole Bloody Affair at the box office at participating cinemas.
2. There are a limited number of prints available at each cinema, to be collected on a first come first served basis.
3. The offer is only available at participating cinemas (The Ritzy, Crouch End, Ealing, Greenwich, Hackney, West Norwood, Picturehouse Central) showing Kill Bill: The Whole Bloody Affair from Friday 05 December 2025.
4. Offer is valid for one print per ticket.
5. There is no cash alternative.
6. Offer may be withdrawn at any time.

Picturehouse Create Short Film Showcase Competition Terms and Conditions (the 'Terms')

1. Acceptance of These Terms 

By submitting your application and Film to the Picturehouse Create Short Film Showcase Competition ('Competition'), you will be deemed to have accepted, and to have agreed to be bound by, these Terms. All instructions, rules and conditions on any advertising or promotional materials relating to the application process and the Competition form part of these Terms, provided that in the event of any conflict or inconsistency, these Terms shall prevail. 

2. Participants 

To enter the Competition, you must: 

  • Be aged 18 years or over 

  • Be resident in the UK or Ireland  

  • Registered passholders for Picturehouse Create 2026 can submit their films for free, subject to the following terms: 

  • The passholder will be provided with a personal waiver code via email 

  • This waiver code can only be used to submit with the same email address used to purchase the Picturehouse Create pass 

  • Any misuse or sharing of this code may result in disqualification from the competition 

  • Pass must already be purchased at the time of entry. Submission fees will not be refunded in the case of a pass being purchased later. 

 

Non-passholders can submit their films for a submission fee of £25. 

 

The Competition is not open to any employees of Picturehouse Cinemas Limited who have been involved in organizing or pre-screening for the festival, or any other persons directly involved in organizing or pre-screening for the festival.  

You may be required to take part in publicity, and by submitting your Film and taking part in the Competition you hereby agree to take part in any such publicity. 

 

3. How to Apply 

To apply to be part of the Competition, you will need to submit your film to the Picturehouse Create FilmFreeway page at [URL] ('FilmFreeway'). Only entries submitted using FilmFreeway will be considered. Your entry and the Film must comply with the following requirements:   

 

a) Picturehouse Create welcomes all types of short films across drama, comedy, animation, documentary and artists' films of all production techniques, forms and budgets. We will accept student films and music videos. However, we will not accept any promotional or commercial videos. 

b) Films must be complete at the time of submitting; we will not accept rough cuts or work-in-progress submissions. The Films must also have been completed no earlier than 1 January 2022 

c) Films can be any length between 1 minute (00:01:00) and 20 minutes (00:20:00), including any credits. Any Films with a run time of less than 1 minute or more than 20 minutes will be disqualified. 

d) Films can be in any language. If the original language of any dialogue or text featured in the Film is not English, the submitted Film must be subtitled in English, unless this is a variance with the filmmaker's intention. All details provided on the Entry Form must be written in English. 

e) The premiere status of your Film is not a key factor in your submission. However, we may ask you to provide a note of festivals at which it has screened. 

f) Films should not be available online for streaming in the UK prior to 18 April 2026. 

g) Films can be submitted by anyone who worked on the film with an onscreen credit, provided they have all necessary rights as detailed in section (h) below. 

h) You must have all necessary rights, licences and permissions from the relevant rights owner (including in relation to any copyrighted music and/or images used within the film) to 

  • submit the Film into the Competition and 

  • to grant to Picturehouse all rights necessary for the screening of the Film at the Picturehouse Create festival, including public screenings at Picturehouse Central and for use for Picturehouse's marketing and publicity purposes as described in these Terms. 

You must produce proof of necessary consents, licenses and permissions to Picturehouse on request. 

i) We accept short films via FilmFreeway ONLY. Speculative submissions sent via email or file links and downloads sent any other way will NOT be watched and will not be entered into the Competition. 

Picturehouse reserves the right, at its sole discretion, to eliminate or disqualify entries that it regards as being in breach of these Terms or the spirit of the Competition. 

Picturehouse accepts no liability for any technical issues of any kind that may prevent anyone from submitting their application to the Competition. 

You may only enter the Competition once. Multiple entries of the same Film will be disqualified. Where Picturehouse discovers or has reasonable grounds to suspect that any entrant has used any software or automated process either to answer questions, enter the Competition, or to make bulk entries, Picturehouse may exclude such entries and disqualify the entrant from the Competition. 

 

4. Closing Date 
The deadline for entering the Competition is 16 March 2026 (GMT 23.59) (the 'Closing Date'). Submissions received after this time will not be considered. 

 

5. Prize 

The prize includes: 

For each Shortlisted Film: 

    a) Screening of the Shortlisted Film at Picturehouse Central on 18 April 2026 as part of the Picturehouse Create Short Film Showcase ('Short Film Screening'). 

    b) Two tickets for the Competition entrant to issue to their guests to attend the Short Film Screening 

For each of the Judge's Choice and the Audience Choice: 

    Prizes a) and b) above, and; 

    i) A prize certificate 

    ii) One year's West End Picturehouse Membership for the Competition entrant 

The full prize package for the 2026 Competition is to be confirmed. Last year's Judge's Choice winner received $10,000 in-kind colour and sound post-production services generously provided by Company 3. Previous awards are indicative of the exciting opportunities Picturehouse aims to offer, but do not guarantee that the same or equivalent prizes will be available in 2026.    

Travel and accommodation expenses are not included and will be the sole responsibility of the entrants and their guests. 

Extra tickets to the Short Film Screening will be available for purchase, subject to availability. 

Prizes are non-transferable, and there will be no cash alternatives for any non-cash elements of the prizes. Picturehouse reserves the right to substitute prizes of equal or greater value at any time in its sole discretion. 

Prizes are awarded at Picturehouse's discretion, and no prizes will be awarded in the case of improper actions by or on behalf of any entrant. Where entries are being judged on creative or artistic merit, or other subjective criteria, the Picturehouse Create selection committee and the Competition judges (acting reasonably) reserve the right not to select any Film(s as Shortlisted Films or the Judge's Choice Film, to remove or amend selection criteria and the structure and operation of the Competition if entries are not of the requisite standard. 

6. The Selection Process 

The Films for the Short Film Screening will be shortlisted from all valid submissions ('Shortlisted Films'). Films will be shortlisted by the Picturehouse Create selection committee. As Picturehouse will curate the Short Film Screening, the number of Films to be chosen as Shortlisted Films will be determined by the Picturehouse Create selection committee during the selection process, at their discretion, taking into account run times of Films, content and various other factors relevant to creating the program for the event. 

Entrants of Shortlisted Films will be notified by email no later than 27 March 2026. Unsuccessful entrants will not be notified and feedback will not be given. 

At the Short Film Screening two winning Films will be chosen from the Shortlisted Films:  

    1. One Film will chosen as Judges' Choice by an Industry Jury 

    2. One Film will be chosen as Audience Choice based on a balloted vote by the Picturehouse Central Audience 

The selection of Winning Films is open to subjective interpretation. For the Judge's Choice award an independent industry jury will be appointed. In all matters, the decision of the jury(s) or selection committee shall be final and no correspondence or discussion shall be entered into. 

Prior to the Short Film Screening, entrants of Shortlisted Films will be required to sign a confirmation form to grant Picturehouse, and their respective group companies, affiliates and agents the right to screen the relevant Film at the Short Film Screening. 

If your Film is selected as a Shortlisted Film, but Picturehouse is unable to contact you, or if your Film/entry is subsequently disqualified from the Competition, we reserve the right to select an alternative Shortlisted Film, selected in accordance with these terms and conditions. Picturehouse's and/or the industry jury's' decision regarding choice of Shortlisted Films and Judges' Choice will be final and no correspondence will be entered into. 

The surname and county of the entrants of Shortlisted Films and Winning Films will be disclosed to anyone who writes within one month after the date of the Short Film Screening and encloses a stamped addressed envelope, to Picturehouse following the instructions in the 'How to contact us' section below. 

7. Intellectual Property Rights and Use of Entries 

The names of entrants of the Shortlisted Films and assets from the Shortlisted Films (such as a text synopsis, clip, trailer or still) may be used by Picturehouse for marketing and promotional purposes including in any media such as on the Picturehouse website and its social media pages, in exhibitions, print, and digital media for the purposes of publicising or promoting Picturehouse Create or other Picturehouse offerings for a period unlimited in time and without further consent or payment. 

Picturehouse does not claim any rights of ownership in your Film. As such, you or the relevant rights owner retains ownership of your Film and all rights therein and, although Picturehouse will be able to use entries for the Short Film Screening and publicity purposes as set out in these Terms, you will also have the right to use your Film. 

Picturehouse does not guarantee to use any Film. Picturehouse may also, in appropriate circumstances, and at its sole discretion, reject, remove or not view Films that it considers may be legally or otherwise problematic. 

You may not submit a Film on behalf of anyone else or in anyone else's name. 

You warrant that your Film and all information which you submit or distribute in relation to your Competition entry, and Picturehouse's use in accordance with these Terms, will not infringe the intellectual property, privacy, or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. In addition, you warrant that you have permission to use or feature any people, content or other material contained within your Film or submission. You agree to indemnify Picturehouse against any claims or damages, including reasonable attorney's fees incurred as a result of any third party claims arising from any breach of your warranty in this section 7. 

  

8. Data Protection 

All personal data which you provide to us in connection with your application and otherwise collected by us in connection with the Competition will be treated in line with Picturehouse Cinemas' Privacy Policy: www.picturehouses.com/privacy, and will only be used and shared for the purposes of as described in these Terms. 

 

In particular: 

  • Picturehouse is the data controller responsible for your personal information obtained in connection with your application and participation in the Competition and Short Film Screening, unless we advise otherwise. 

  • Picturehouse will process, and permit the processing of, your personal data submitted by you or collected by us or on our behalf for the purposes of the Competition, your application to participate in the Competition and Competition marketing and for related record-keeping purposes. Please note that such materials, if published, may be visible to anyone who visits our websites, uses our apps, engages with our social media or receives our communications (including our e-newsletters), whether within or outside the United Kingdom. 

  • It is in Picturehouse's legitimate interest to use and process your personal information in connection with your application to be part of and to participate in the Competition. 

  • You have certain rights in relation to your personal data, including: to obtain copies of it; to have it corrected or deleted; to limit the way in which it is used; to object to its use; to transfer it; not to be subject to decisions based on automated processing (including profiling); and to complain to the regulator, the UK Information Commissioner's Office. You can find details about how to do this on their website at ico.org.uk/concerns or by calling their helpline on 0303 123 1113. Please note that many of these rights are not absolute and the extent to which they apply may vary depending on the circumstances and any exemptions that may apply

9. Promoter and Promoter's Right 

The promoter of the Competition is Picturehouse Cinemas Limited. Registered office: 8th Floor, Vantage London, Great West Road, Brentford, TW8 9AG. Picturehouse Cinemas reserves the right to (i) amend these Terms at any time and without notice, and (ii) terminate or suspend the submission process and Competition at any time due to circumstances beyond its control. 

 

10. Exclusion 

Anything not specified in these Terms as being included in the application process and / or Competition is excluded. 

 

11. Limitation of Liability 

Proof of submission of your entry will not be accepted as proof of delivery. Picturehouse shall bear no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of or unauthorised access to Films or related entries, or Films or entries lost, damaged or delayed as a result of server functions, technical issues, virus, bugs or other causes outside Picturehouse's control, or otherwise. 

Entrants should note that Picturehouse does not accept responsibility for the safekeeping or return of any Films or submitted information or assets, including those consisting of artistic or other material. 

You agree to the fullest extent allowed by applicable law to release and forever discharge Picturehouse Cinemas Limited and its affiliate companies, assigns and employees, and any entity or person connected with the Competition from and against any and all claims, demands, losses and liabilities of any nature whatsoever which may now or hereafter arise, including but not limited to any loss of enjoyment, costs, delays or other harm or loss of any nature whatsoever caused by, contributed to, or arising out of or in connection with the Competition entry process, Short Film Screening, the Prize and/or the Competition. 

  

12. Jurisdiction 

These Terms (and any related disputes) are subject to interpretation under the laws of England and Wales, and to the jurisdiction of the courts of England and Wales.
